HOUSE RESOLUTION NO. 127
BY REPRESENTATIVE ELLINGTON
TELECOMMUNICATIONS:  Memorializes the president, congress, and Federal
Communications Commission to refrain from regulating Internet broadband services
as common carrier services under Title II of the Communications Act of 1934
A RESOLUTION1
To memorialize the president of the United States, the United States Congress, and the2
Federal Communications Commission to refrain from regulating Internet broadband3
services as common carrier services under Title II of the Communications Act of4
1934.5
WHEREAS, due in large part to the unregulated efforts of private enterprise over the6
past twenty-five years, the development of the Internet has dramatically transformed the way7
Louisiana citizens work, live, and learn; and8
WHEREAS, the deployment of efficient, fast, and reliable broadband networks9
throughout the state has created thousands of jobs and many benefits for local economies;10
and11
WHEREAS, in order to encourage the growth and development of the Internet, the12
Federal Communications Commission (FCC) historically has refrained from regulating13
broadband Internet services as common carrier services under Title II of the14
Communications Act of 1934; and15
WHEREAS, as a result, the United States has been at the forefront of technological,16
business, and social innovation on the Internet; and17
WHEREAS, on May 6, 2010, the chairman of the FCC announced a policy to18
reclassify broadband Internet services as common carrier services so that they can be more19 HLS 10RS-4847	ORIGINAL

tightly regulated, with a proposal to forebear from imposing certain common carrier1
obligations on broadband Internet providers; and2
WHEREAS, using antiquated provisions of Title II of the Communications Act of3
1934 to regulate the Internet will slow investment in Louisiana's Internet broadband4
infrastructure and jeopardize future job growth.5
THEREFORE, BE IT RESOLVED that the House of Representatives of the6
Legislature of Louisiana does hereby memorialize the president of the United States, the7
United States Congress, and the Federal Communications Commission to refrain from8
regulating Internet broadband services as common carrier services under Title II of the9
Communications Act of 1934.10
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the11
president of the United States, to the presiding officers of the Senate and the House of12
Representatives of the United States Congress, to each member of the Louisiana13
congressional delegation, and to the chairman of the Federal Communications Commission.14
