HLS 10RS-5492 ORIGINAL Page 1 of 3 Regular Session, 2010 HOUSE RESOLUTION NO. 202 BY REPRESENTATIVE BILLIOT FIRE PROTECT/FIREMEN: Requests the Professional Firefighters Assoc. of La. to study issues related to making municipal fire civil service laws applicable to not-for-profit organizations that enter into cooperative endeavors with certain municipalities, parishes, and fire protection districts to provide fire protection services A RESOLUTION1 To urge and request the Professional Firefighters Association of Louisiana to study the2 issues related to making municipal fire civil service laws applicable to not-for-profit3 organizations that enter into cooperative endeavors with certain municipalities,4 parishes, and fire protection districts to provide fire protection services.5 WHEREAS, Article X, Section 16 of the Constitution of Louisiana establishes a6 system of classified fire and police civil service in each municipality having a population7 exceeding thirteen thousand and operating a regularly paid fire and municipal police8 department and in each parish and fire protection district operating a regularly paid fire9 department; and10 WHEREAS, R.S. 33:2471 et seq. and R.S. 33:2531 et seq. establish classified civil11 service systems for policemen and firemen employed in municipalities with a population of12 not less than seven thousand and not more than two hundred fifty thousand persons13 according to the latest federal decennial census and in all parishes and fire protection14 districts; and15 WHEREAS, R.S. 33:2471 et seq. and R.S. 33:2581 et seq. provide provisions that16 govern employees in the classified fire and police service, including municipal fire and17 police civil service boards, classification plans, employment lists, reinstatement and18 reemployment, admission to tests, certification and appointment, leaves of absences, lay-19 offs, and appeals; and20 HLS 10RS-5492 ORIGINAL HR NO. 202 Page 2 of 3 WHEREAS, many not-for-profit organizations enter into cooperative endeavors with1 municipalities, parishes, and fire protection districts governed by the provisions of R.S.2 33:2471 et seq. and R.S. 33:2581 et seq. to provide fire protection services and employ3 persons in positions that have as their primary duty and responsibility one of the following:4 (1) The chief and assistant chiefs; the intradepartmental division, bureau, squad,5 platoon, and company officers of the fire department.6 (2) Firefighting.7 (3) Fire prevention; inspection.8 (4) Driving, tillering, and operation of fire apparatus.9 (5) Operations and maintenance of radio, fire alarm, or signal system.10 (6) Fire department instructors in employee training.11 (7) Fire salvage and overhauling services, first aid, advanced life support, and12 emergency medical services.13 (8) Automotive or fire apparatus repairs, if such service is operated exclusively by14 and for either or both the fire or police department.15 (9) Secretary to the chief. Departmental records clerk; and16 WHEREAS, the employees of not-for-profit organizations that enter into such17 cooperative endeavors are not covered by the provisions of R.S. 33:2471 et seq. and R.S.18 33:2581 et seq; and19 WHEREAS, many of the not-for-profit organizations do not provide adequate20 protections for their employees who constantly work under life threatening conditions; and21 WHEREAS, the employees of not-for-profit organizations that enter into cooperative22 endeavors with municipalities, parishes, and fire protection districts governed by the23 provisions of R.S. 33:2471 et seq. and R.S. 33:2581 et seq. provide the same service as24 employees of the classified fire service and deserve to have the same protections; and25 WHEREAS, many not-for-profit organizations that enter into such cooperative26 endeavors have not been open to providing adequate protections for their employees.27 THEREFORE, BE IT RESOLVED that the House of Representatives of the28 Legislature of Louisiana does hereby urge and request the Professional Firefighters29 Association of Louisiana to study the issues related to making municipal fire civil service30 HLS 10RS-5492 ORIGINAL HR NO. 202 Page 3 of 3 laws applicable to not-for-profit organizations that enter into cooperative endeavors with1 certain municipalities, parishes, and fire protection districts to provide fire protection2 services.3 DIGEST The digest printed below was prepared by House Legislative Services.
