AN ACT1
To enact R.S. 22:978(D), relative to health and accident insurance; to provide with respect2
to responses to written requests for aggregate paid claims, premium data, and3
utilization data; to provide for penalties; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 22:978(D) is hereby enacted to read as follows: 6
ยง978. Group, family group, blanket, and association health and accident insurance;7
notice required for certain premium increase, cancellation, or8
nonrenewal9

D. At least ninety days prior to the date on which a group policy is to be11
renewed or terminated, every health insurance issuer providing coverage to an12
employer group comprising more than one hundred enrolled employees shall13
provide the employer group with information as to the premium rate or amount14
to be paid to renew the group policy for the next policy year. No later than15
eighty days prior to the date of renewal or termination, the employer group may16
make written request, by certified mail, to the group insurance issuer for the17
currently available utilization data and aggregate paid claims and premium18
data accumulated for the period of the current policy year. The health19

insurance issuer shall provide this data to the employer group within fourteen1
business days of receipt of the request.2
