Regular Session, 2010 SENATE BILL NO. 174 BY SENATOR SMITH WEAPONS. Reduces training course requirements for a concealed weapons permit for combat veterans. (8/15/10) AN ACT1 To amend and reenact R.S. 40:1379.3(D)(2) and to enact R.S. 40:1379.3(D)(1)(i), relative2 to statewide permits for concealed handguns; to reduce training requirements on3 combat veterans; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 40:1379.3(D)(2) is hereby amended and reenacted and R.S.6 40:1379.3(D)(1)(i) is hereby enacted to read as follows: 7 ยง1379.3. (i) Completion of the field proficiency test and the legal instruction on1 the use of deadly force and conflict resolution component of any National Rifle2 Association handguns safety or training course conducted by a National Rifle3 Association certified instructor within the preceding twelve months;4 (ii) Completion of the field proficiency test and the legal instruction on5 the use of deadly force and conflict resolution component of any Department of6 Public Safety and Corrections approved firearms safety or training course or7 class available to the general public offered by a law enforcement agency,8 college, or private or public institution or organization or firearms training9 school within the preceding twelve months.10 (iii) Completion of the field proficiency test and the legal instruction on11 the use of deadly force and conflict resolution component of any firearms12 training or safety course or class approved by the Department of Public Safety13 and Corrections within the preceding twelve months.14 * * *15 (2) Instructors for any class, training, or course of instruction authorized by16 this Subsection, except for small arms training in military service as provided in17 Subparagraph (1)(g) of this Subsection, shall be certified as an instructor by the18 National Rifle Association as an instructor for civilians or law enforcement or by the19 Council on Peace Officer Standards and Training as a firearms instructor. DIGEST Present law provides various qualifications for individuals seeking concealed handgun permits as well as a demonstration of competence with a handgun evidenced by completion of an approved training program taught by a certified instructor. Present rule (L.A.C. 55:1311) provides that the training programs generally consists of the following: (1)One hour of instruction on handgun nomenclature and safe handling procedures of a revolver and semi-automatic pistol. (2)One hour of instruction on ammunition knowledge and fundamentals of pistol shooting. (3)One hour of instruction on handgun shooting positions. (4)Three hours of legal instruction on the use of deadly force and conflict resolution which includes a review of the criminal statutes regarding justifications, justifiable homicide, self-defense and defense of others and may include other laws relating to the use of deadly force. (5)One hour of instruction on child access prevention. (6)Two hours of actual live range fire and proper handgun cleaning procedures. Live range fire includes 12 rounds shot at each of 6 feet, 10 feet and 15 feet for a total of 36 rounds. At least one safe reload of the handgun must be performed at each distance and the applicant or permittee must score 100% hits with the silhouette portion of a N.R.A. B-27 type silhouette target with at least 36 rounds. Propose law provides that a combat veteran may demonstrate competence with a handgun by proof of his combat veteran status and completion of the field test and legal instruction components of a training class.
