AN ACT1
To amend and reenact R.S. 37:793(G) and to enact R.S. 37:793(B)(5), relative to the2
administration of nitrous oxide inhalation analgesia; to provide for the administration3
of nitrous oxide inhalation analgesia by certain dental hygienists; to provide for a4
permit; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 37:793(G) is hereby amended and reenacted and R.S. 37:793(B)(5)7
is hereby enacted to read as follows: 8

sedation; deep sedation; general anesthesia; definitions; permits;10
credentials; reporting; fees; limitations; exceptions11

B. The following terms describing routes of administration shall have the13
meanings ascribed to them unless the context clearly indicates otherwise:14

(5) A dental hygienist who administers nitrous oxide inhalation analgesia16
in a dental practice shall receive a personal permit from the board and shall be17 SB NO. 214

in compliance with board rules and regulations.1

G. The authority for the administration of nitrous oxide inhalation analgesia,3
enteral conscious sedation, parenteral conscious sedation, deep sedation, and general4
anesthesia anesthetic and sedative agents as described in this Section shall be5
limited to qualified dentists licensed by the board for use on dental patients. as6
follows:7
(1) The administration of enteral conscious sedation, parenteral8
conscious sedation, deep sedation, and general anesthesia shall be limited to9
qualified dentists licensed by the board for use on dental patients.10
(2) The administration of nitrous oxide inhalation analgesia shall be11
limited to qualified dentists and dental hygienists licensed by the board for use12
on dental patients. Dental hygienists shall administer nitrous oxide inhalation13
analgesia only under the direct supervision of a dentist licensed by the14
Louisiana State Board of Dentistry to whom the board has issued a permit to15
administer nitrous oxide inhalation analgesia.16

DIGEST
Present law provides that the authority for the administration of nitrous oxide inhalation
analgesia, enteral conscious sedation, parenteral conscious sedation, deep sedation, and
general anesthesia shall be limited to qualified dentists licensed by the board for use on
dental patients.
Proposed law retains present law and expands the administration of nitrous oxide to dental
hygienists licensed by the board and who have obtained a permit for the administration of
nitrous oxide inhalation analgesia.
Proposed law further provides that the dental hygienist shall administer nitrous oxide
inhalation analgesia under the direct supervision of a dentist licensed by the Louisiana State
Board of Dentistry to whom the board has issued a permit to administer nitrous oxide
inhalation analgesia.
Effective August 15, 2010.
