SENATE BILL NO. 255
BY SENATORS CHAISSON AND THOMPSON 
WORKERS' COMPENSATION.  Provides relative to electronic medical billing
requirements for workers' compensation matters.(8/15/10)
AN ACT1
To enact R.S. 23:1203.2, relative to electronic medical billing for workers' compensation2
claims; to provide for electronic submission of medical bills; to provide for3
electronic processing and payment of medical bills; to provide for acceptance of4
electronic payment; to provide for rules and regulations; and to provide for related5
matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 23:1203.2 is hereby enacted to read as follows: 8
ยง1203.2. Electronic medical billing and payment9
A.(1) The director shall adopt rules and regulations regarding the10
electronic submission, processing, and payment of workers' compensation-11
related medical bills, in accordance with the Administrative Procedure Act, R.S.12
49:950 et seq.13
(2)  Such rules shall take effect no later than January 1, 2012.14
B. The following groups shall make provisions for such an electronic15
claims system:16

by health care providers, in accordance with the rules promulgated.1
(2) Health care providers shall accept payment of medical claims2
submitted electronically by insurance carriers, in accordance with the rules3
promulgated.4
C. On or after January 1, 2012, the director may adopt additional rules5
and regulations, in accordance with the Administrative Procedure Act, R.S.6
49:950 et seq., regarding the electronic exchange of medical claims information.7

Present law contains no provision requiring electronic submission, processing, or payment
of workers' compensation-related medical bills.
Proposed law provides that the director of the office of workers' compensation shall adopt
rules and regulations regarding an electronic system of submission, processing, and payment
of workers' compensation-related medical bills.
Proposed law provides that insurance carriers shall accept electronic medical bills and health
care providers shall accept electronic payment of such bills.
Proposed law provides that on or after 1/1/12, the director may promulgate additional rules
and regulations regarding the electronic medical billing system.
Effective August 15, 2010.
