MOTOR VEHICLES. Exempts a registered owner of a motor vehicle who is a member of
the armed services from the duty to maintain liability security while on active duty overseas.

AN ACT1
To enact R.S. 32:861.1, relative to motor vehicles and security; to exempt the registered2
owner of a motor vehicle who is a member of the armed services from the duty to3
maintain liability security while on active duty overseas; and to provide for related4
matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 32:861.1 is hereby enacted to read as follows: 7
ยง861.1.  Security required; exemption for active duty overseas8
A. The registered owner of a motor vehicle who is a member of the9
armed services is exempt from the provisions of Chapter 5 of this Title, while10
on active duty overseas, provided the owner notifies the commissioner that he11
wishes to discontinue the use of a vehicle registered in his name by notarized12
affidavit within fifteen business days of cancellation of liability security on the13
vehicle. Such affidavit shall set forth the date upon which the vehicle will no14
longer be in use, the intended period of nonuse, and site storage address of the15
vehicle.  The owner shall attach a copy of his orders to active duty overseas to16
his notarized affidavit.17 SB NO. 27

B. This exemption terminates on the final date of nonuse as set forth in1
the affidavit or upon a subsequent report of liability security on the vehicle to2
the office of motor vehicles, whichever occurs first.3

Proposed law provides that the registered owner of a motor vehicle who is a member of the
armed services is exempt from the provisions of the Motor Vehicle Safety Responsibility
Law, while on active duty overseas.
Proposed law provides that the owner must notify the commissioner that he wishes to
discontinue the use of a vehicle registered in his name by notarized affidavit within fifteen
business days of cancellation of liability security on the vehicle. Requires that said affidavit
set forth the date upon which the vehicle will no longer be in use, the intended period of
