Requires a nonresident contractor to include its tax identification number on permit applications along with proof that contractor has registered to do business in the state. (8/15/10) AN ACT1 To amend and reenact R.S. 37:2171.2(B) and to enact R.S. 37:2171.2(C), relative to2 requirements for building permits; to require nonresident contractors to provide3 certain additional information prior to issuance of a permit; and to provide for related4 matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. DIGEST Donahue (SB 291) Present law provides that prior to the issuance of any building permit, the local building permit official requires that the applicant for such permit produce proof that the applicant possesses an active, applicable contractors license issued by the board, or that the applicant's proposed building activity is exempt from such licensure under present law. The local building permit official further requires any applicant claiming an exemption for residential construction activities to execute an affidavit attesting to the claimed exemption. Such affidavit must be submitted to the local building permit official prior to the issuance of a permit. Such affidavit must be executed on a form provided by the contractors' board. Proposed law retains present law, but further requires nonresident commercial, residential, or home improvement contractor applicants to provide a federal taxpayer identification number to the local building permit official, as well as proof of registration to do business in this state. Effective August 15, 2010. (Amends R.S. 37:2171.2(B); adds R.S. 37:2171.2(C)) Summary of Amendments Adopted by Senate Senate Floor Amendments to engrossed bill. 1. Clarifies that a nonresident contractor applicant providing its federal taxpayer identification number to the local building permit official applies to commercial, residential or home improvement contractors.
