(8/15/10) AN ACT1 To amend and reenact R.S. 46:1606(A) and (B)(1), relative to the office of elderly affairs;2 to increase the appropriations to each parish council on aging; and to provide for3 related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 46:1606(A) and (B)(1) are hereby amended and reenacted to read as6 follows: 7 ยง1606. Annual appropriation8 A. The legislature shall appropriate to the office of elderly affairs, for9 distribution by the executive director of the office to the various voluntary parish10 councils on aging, funds sufficient to allocate to each parish council two dollars and11 fifty cents five dollars for each person sixty years or older who is a resident of the12 parish as shown by the latest official census estimate or thirty-seven thousand five13 hundred dollars, fifty thousand dollars whichever is greater, but not to exceed one14 hundred thousand dollars to any one parish council. The office of elderly affairs shall15 include funds in their annual budget request for increases in funding based on the16 number of elderly as estimated in the above census. Notwithstanding the foregoing,17 SB NO. 362 SLS 10RS-856 ORIGINAL Page 2 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. such total annual appropriation shall be for a minimum of two million seven hundred1 seventy-six thousand eight hundred dollars six million eight hundred and thirty2 thousand dollars.3 B.(1) Funds appropriated by the legislature pursuant to Subsection A of this4 Section shall be distributed by the executive director of the office of elderly affairs5 and shall be allocated to each parish council in an amount equal to two dollars and6 fifty cents five for each resident of the parish age sixty years or older, as shown by7 the latest official estimate approved by the United States Bureau of the Census, or8 thirty-seven thousand five hundred dollars fifty thousand dollars, whichever is9 greater, but not to exceed one hundred thousand dollars for any one parish council.10 The sums so allocated shall be distributed quarterly during the first thirty days of11 each quarter of the fiscal year. In appropriating funds pursuant to this Section, the12 legislature shall specifically provide for the allocation of funds to the respective13 parish councils in accordance with the provisions of this Section.14 * * *15 Section 2. DIGEST Present law requires an appropriation to the office of elderly affairs to be distributed to the parish councils on aging consisting of an allocation of $2.50 for each person age 60 and older or $37,000, whichever is greater, but not to exceed $100,000 to any one parish. The total annual appropriation cannot be for an amount less than $2,776,800. Present law mandates that the balance of any funds appropriated pursuant to present law be allocated quarterly during the first 30 days of each quarter of the fiscal year. Proposed law changes present law by requiring an appropriation to the office of elderly affairs to be distributed to the parish councils on aging consisting of an allocation of $5.00 for each person age 60 and older, or $50,000, whichever is greater. The total annual appropriation cannot be for an amount less than $6,830,000. Provides for effectiveness of the Act contingent upon the appropriation of funds sufficient for the purposes intended. Effective August 15, 2010. (Amends R.S. 46:1606(A) and (B)(1))
