SENATE BILL NO. 374
BY SENATOR MORRELL 
CRIMINAL PROCEDURE.  Requires that time served by a habitual offender be served at
hard labor. (8/15/10)
AN ACT1
To amend and reenact R.S. 15:529.1(G), relative to the habitual offender law; to provide for2
imprisonment at hard labor for persons sentenced under the habitual offender law;3
and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 15:529.1(G) is hereby amended and reenacted to read as follows:6
ยง529.1. Sentences for second and subsequent offenses; certificate of warden or7
clerk of court in the state of Louisiana as evidence 8

G. Any sentence imposed under the provisions of this Section shall be at10
hard labor without benefit of probation or suspension of sentence.11

DIGEST
Present law provides for persons sentenced for second and subsequent offenses as habitual
offenders. Provides that sentences imposed under the habitual offender law be served
without benefit of probation or suspension of sentence.
Proposed law retains these provisions but requires that sentences imposed by at hard labor.
Effective August 15, 2010.
