LANDS/WATERBOTTOM.  Authorizes transfer and acceptance of certain properties by the
Department of Culture, Recreation and Tourism and by the Department of Wildlife and
Fisheris. (8/15/10)
AN ACT1
To authorize and provide for the transfer of certain state properties in Caldwell Parish; to2
provide for the acceptance of certain properties by the Department of Wildlife and3
Fisheries; to provide for the property description; to provide for reservation of4
mineral rights; to provide terms and conditions; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. The commissioner of administration and the secretary of the7
Department of Culture, Recreation and Tourism, notwithstanding any other provision8
of law to the contrary, are hereby authorized and empowered to convey, transfer,9
assign, and deliver any interest, excluding mineral rights, the state may have to all or10
any portion of the following described parcel of property to the governing authority of11
Caldwell Parish:12
A certain tract of land, including all improvements located thereon, situated in13
Lots One (1) and Two (2) of Block Two (2) of the Alford Subdivision in Section14
42, Township 13 North, Range Four (4) East, as per plat and map on file in the15
Clerk's Office of Caldwell Parish, Louisiana, containing approximately 0.4016
acres, more or less, Parish of Caldwell, State of Louisiana.17 SB NO. 397

Section 2. The secretary of the Department of Wildlife and Fisheries,1
notwithstanding any other provision of law to the contrary, is hereby authorized and2
empowered to convey, transfer, assign, and deliver any interest, excluding mineral3
rights, the state may have to all or any portion of the following described parcels of4
property to Gary D. Mott:5
A. A certain tract of land, including all improvements located thereon,6
situated north of Bayou Lafourche in the Southwest Quarter of the7
Northeast Quarter of Section 33, Township 14 North, Range 5 East,8
containing 29.5 acres, more or less, Parish of Caldwell, State of9
Louisiana.10
B. A certain tract of land, including all improvements located thereon,11
situated in the Southwest Quarter of Section 3, Township 13 North,12
Range 5 East, containing 4.3 acres, more or less, Parish of Caldwell,13
State of Louisiana.14
Section 3. In exchange for the above described properties in Section 2, the15
secretary of the Department of Wildlife and Fisheries, notwithstanding any other16
provision of law to the contrary, is hereby authorized and empowered to accept17
delivery of title to all or any portion of the following described parcels of property,18
excluding mineral rights, from Gary D. Mott:19
A certain tract of land, including all improvements located thereon,20
situated in the following lots: Lot 1, the East half of Lot 8, and Lot 10 of21
the A.C. Mott Subdivision filed in Plat Book 2, Page 3, now in Plat22
Cabinet No. 1, Slide No. 16-D, and being a portion of the Northwest23
Quarter of the Northwest Quarter of Section 33, Township 14 North,24
Range 5 East, as per plat dated April, 1958, by R. M. Irwin, under File25
No. 100930, records of Caldwell Parish, Louisiana, and Lots 3 and 4 of26
Section 33, Township 14 North, Range 5 East, containing a total of 41.627
acres, more or less.28

Department of Culture, Recreation and Tourism, on behalf of the state of Louisiana,1
are hereby authorized to enter into such agreements, covenants, conditions, and2
stipulations and to execute such documents as necessary to properly effectuate any3
conveyance, transfer, assignment, or delivery of title, excluding mineral rights, to the4
property described in Section 1, and as more specifically described in any such5
agreements entered into and documents executed by and between the commissioner of6
administration and the secretary of the Department of Culture, Recreation and7
Tourism and the governing authority of Caldwell Parish, in exchange of consideration8
proportionate to the appraised value of the properties.9
Section 5. The secretary of the Department of Wildlife and Fisheries, on behalf10
of the state of Louisiana, is hereby authorized to enter into such agreements, covenants,11
conditions, and stipulations and to execute such documents as necessary to properly12
effectuate any conveyance, transfer, assignment, acceptance or delivery of title,13
excluding mineral rights, to the properties described in Sections 2 and 3, and as more14
specifically described in any such agreements entered into and documents executed by15
and between the secretary of the Department of Wildlife and Fisheries and Gary D.16
Mott, in exchange of consideration proportionate to the appraised value of the17
properties.18
