SENATE BILL NO. 397

AN ACT1
To authorize and provide for the transfer of certain state properties in Caldwell Parish; to2
provide for the acceptance of certain properties by the Department of Wildlife and3
Fisheries; to provide for the property description; to provide for reservation of4
mineral rights; to provide terms and conditions; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. The commissioner of administration and the secretary of the7
Department of Culture, Recreation and Tourism, notwithstanding any other provision8
of law to the contrary, are hereby authorized and empowered to convey, transfer,9
assign, and deliver any interest, excluding mineral rights, the state may have to all or10
any portion of the following described parcel of property to the governing authority of11
Caldwell Parish:12
A certain tract of land, including all improvements located thereon,13
situated in Lots One (1) and Two (2) of Block Two (2) of the Alford14
Subdivision in Section 42, Township 13 North, Range Four (4) East, as15
per plat and map on file in the Clerk's Office of Caldwell Parish,16
Louisiana, containing approximately 0.40 acres, more or less, Parish of17
Caldwell, State of Louisiana.18
Section 2.  The secretary of the Department of Wildlife and Fisheries,19
notwithstanding any other provision of law to the contrary, is hereby authorized and20
empowered to convey, transfer, assign, and deliver any interest, excluding mineral21
rights, the state may have to all or any portion of the following described parcels of22
property to Gary D. Mott:23
A. A certain tract of land, including all improvements located thereon,24
situated north of Bayou Lafourche in the Southwest Quarter of the25
Northeast Quarter of Section 33, Township 14 North, Range 5 East,26
containing 29.5 acres, more or less, Parish of Caldwell, State of27 SB NO. 397	ENROLLED

B. A certain tract of land, including all improvements located thereon,2
situated in the Southwest Quarter of Section 3, Township 13 North,3
Range 5 East, containing 4.3 acres, more or less, Parish of Caldwell,4
State of Louisiana.5
Section 3.  In exchange for the above described properties in Section 2, the6
secretary of the Department of Wildlife and Fisheries, notwithstanding any other7
provision of law to the contrary, is hereby authorized and empowered to accept8
delivery of title to all or any portion of the following described parcels of property,9
excluding mineral rights, from Gary D. Mott:10
A certain tract of land, including all improvements located thereon,11
situated in the following lots: Lot 1, the East half of Lot 8, and Lot 10 of12
the A.C. Mott Subdivision filed in Plat Book 2, Page 3, now in Plat13
Cabinet No. 1, Slide No. 16-D, and being a portion of the Northwest14
Quarter of the Northwest Quarter of Section 33, Township 14 North,15
Range 5 East, as per plat dated April, 1958, by R. M. Irwin, under File16
No. 100930, records of Caldwell Parish, Louisiana, and Lots 3 and 4 of17
Section 33, Township 14 North, Range 5 East, containing a total of 41.618
acres, more or less.19
Section 4. The commissioner of administration and the secretary of the20
Department of Culture, Recreation and Tourism, on behalf of the state of Louisiana,21
are hereby authorized to enter into such agreements, covenants, conditions, and22
stipulations and to execute such documents as necessary to properly effectuate any23
conveyance, transfer, assignment, or delivery of title, excluding mineral rights, to the24
property described in Section 1, and as more specifically described in any such25
agreements entered into and documents executed by and between the commissioner of26
administration and the secretary of the Department of Culture, Recreation and27
Tourism and the governing authority of Caldwell Parish, in exchange of consideration28
proportionate to the appraised value of the properties.29

of the state of Louisiana, is hereby authorized to enter into such agreements, covenants,1

excluding mineral rights, to the properties described in Sections 2 and 3, and as more4
specifically described in any such agreements entered into and documents executed by5
and between the secretary of the Department of Wildlife and Fisheries and Gary D.6
Mott, in exchange of consideration proportionate to the appraised value of the7
properties.8
