Regular Session, 2010 SENATE BILL NO. 412 BY SENATOR DONAHUE PUBLIC BUILDINGS/GROUNDS. Creates the State Buildings and Lands Highest and Best Use Advisory Group. (7/1/10) AN ACT1 To enact R.S. 39:332.1, relative to property control; to create the State Buildings and Lands2 Highest and Best Use Advisory Group; to provide for duties and responsibilities; to3 provide for an effective date; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 39:332.1 is hereby enacted to read as follows: 6 ยง332.1 State Buildings and Lands Highest and Best Use Advisory Group;7 creation8 A. The State Buildings and Lands Highest and Best Use Advisory Group,9 hereinafter referred to as the "Advisory Group." is hereby created to be10 composed of the director of the office of facility planning and control, the11 director of the office of state lands, the director of the office of risk12 management, and the director of the office of statewide reporting and13 accounting policy or their designees.14 B. The Advisory Group shall advise the commissioner of administration15 on all matters relating to state-owned property and development opportunities16 for the state to enter into public-private development partnerships with private,17 SB NO. 412 SLS 10RS-138 ORIGINAL Page 2 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. non-profit or public partners, chosen by competitive bid, in order to develop1 and manage state-owned real estate in a manner that achieves the highest and2 best use of the property.3 C.(1) By the first of November each year, each agency in the executive4 branch, including each higher education agency which is funded or proposed5 by the Board of Regents to be funded through the higher education funding6 formula, shall report to the Advisory Group any land or buildings under the7 control of such agency that, in the estimation of the agency, is being8 underutilized or may represent an opportunity to be developed in accordance9 with the highest and best use of the property.10 (2) The Advisory Group shall review and analyze the various reports and11 shall, not later than January fifteenth of each year, make recommendations to12 the commissioner of administration regarding which properties present the13 most promise for development including public-private development.14 (3) The commissioner shall review the list of properties recommended15 by the Advisory Group and finalize the list of properties by accepting the list or16 by removing properties from the list. At the regular March meeting of the Joint17 Legislative Committee on the Budget , the commissioner of administration shall18 present the final list of such properties with a plan for the development of the19 highest and best use of such properties.20 Section 2. This Act shall become effective on July 1, 2010; if vetoed by the governor21 and subsequently approved by the legislature, this Act shall become effective on July 1,22 2010, or on the day following such approval by the legislature, whichever is later.23 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Jay R. Proposed law provides for the Advisory Group to advise the commissioner of administration on all matters relating to state-owned property and development opportunities for the state to enter into public-private development partnerships with private, non-profit or public partners, chosen by competitive bid, in order to develop and manage state-owned real estate in a manner that achieves the highest and best use of the property. Proposed law requires that, by November 1 each year, each executive branch including higher education agencies, report to the Advisory Group any land or buildings under the control of such agency that, in the estimation of the agency, is being underutilized or may represent an opportunity to be developed in accordance with the highest and best use of the property.
