SENATE BILL NO. 423

GOVERNMENT ORGANIZATION. Provides for reserve investigators in the Louisiana
Inspector General's Office. (gov sig)
AN ACT1
To enact R.S. 49:220.26, relative to state administration; to provide for reserve investigators2
in the Louisiana Inspector General's Office; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1.  R.S. 49:220.26 is hereby enacted to read as follows: 5
ยง220.26.  Reserve investigators6
A. Any person who has served as an investigator for the office of the7
state inspector general and who retired or otherwise left the employment of the8
department in good standing and who has maintained certification and9
currently is certified by the POST Council, or any other person who has served10
as a peace officer and who has maintained certification and currently is certified11
by the POST Council, may be appointed as a reserve investigator for the office12
of the state inspector general under the provisions of this Subpart.13
B.  The inspector general shall be authorized to issue a reserve14
investigator's appointment as provided herein if the person satisfies the15
following requirements:16
(1)  Qualifies on the Police Officer Standard Training firearms course.17 SB NO. 423

(2) Attends any seminars, workshops, or other meetings on issues related1
to the operation of the office of inspector general which may be required by the2
inspector general.3
(3) Complies with any other rule or regulation as may be required by4
the inspector general.5
C. Each reserve investigator shall have all the powers of and may6
function as a criminal investigator for the office of inspector general, but shall7
receive no compensation for his participation in the reserve investigator8
program. Expenses incurred by a reserve investigator in the course and scope9
of performing his official duties shall be reimbursed.10
D. The inspector general shall have the power to revoke any reserve11
investigator's appointment at any time.12
E. Reserve investigators' appointments shall only be valid for a period13
of one year from the date of issuance; however, they may be renewed annually14
at the discretion of the inspector general.15
F. Upon the recommendation of the inspector general, each reserve16
investigator shall be eligible to apply to the superintendent of state police for a17
special officer's commission from the Louisiana Division of State Police under18
the applicable provisions of R.S. 40:1379.1.19
Section 2. This Act shall become effective upon signature by the governor20
or, if not signed by the governor, upon expiration of the time for bills to become law21
without signature by the governor, as provided in Article III, Section 18 of the22
Constitution of Louisiana. If vetoed by the governor and subsequently approved by23
the legislature, this Act shall become effective on the day following such approval.24

enforcement agency and may employ persons whose responsibility is to conduct

Proposed law provides that the office of the inspector general may employ former
investigators and law enforcement persons as reserve investigators if such persons
have maintained certification and are currently certified by the POST Council.
Proposed law provides that the inspector general will be authorized to issue a reserve
investigator's appointment to persons who have satisfied certain requirements of the
office of the inspector general.
Proposed law provides the inspector general the authority to revoke a reserve
investigator's appointment at any time.
Proposed law provides that reserve investigators will receive no compensation for
his participation in the reserve investigator program but will be reimbursed for their
expenses incurred during the course and scope of performing their official duties.
Proposed law provides that reserve investigators appointments will be for one year
from the date of issuance and may be renewed annually at the discretion of the
inspector general.
Proposed law provides that upon recommendation by the inspector general, each
reserve investigator shall be eligible to apply to the superintendent of state police for
a special officer's commission from the division of state police.
Effective upon signature of the governor or lapse of time for gubernatorial action.
