GOVERNMENT ORGANIZATION. Provides for reserve investigators in the Louisiana
Inspector General's Office. (gov sig)
AN ACT1
To enact R.S. 49:220.26, relative to state administration; to provide for reserve investigators2
in the Louisiana Inspector General's Office; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1. R.S. 49:220.26 is hereby enacted to read as follows: 5
ยง220.26. Reserve investigators6
A. Any person who has served as a full time investigator for the office7
of the state inspector general and who retired or otherwise left the full time8
employment of the department in good standing and who has maintained9
certification and currently is certified by the POST Council, or any other person10
who has served as a Louisiana peace officer and who has maintained11
certification and who graduated from a Louisiana POST certified academy may12
be appointed as a reserve investigator for the office of the state inspector13
general.14
B. The inspector general shall be authorized to issue a reserve15
investigator's appointment as provided herein if the person satisfies the16

(1) Qualifies on the Peace Officer Standards and Training firearms1
course.2
(2) Attends any seminars, workshops, or other meetings on issues related3
to the operation of the office of inspector general which may be required by the4
inspector general.5
(3) Complies with any other rule or regulation as may be required by6
the inspector general.7
C. Each reserve investigator shall have all the powers of and may8
function as a criminal investigator for the office of inspector general, but shall9
receive no compensation for his participation in the reserve investigator10
program. Expenses incurred by a reserve investigator in the course and scope11
of performing his official duties shall be reimbursed.12
D. The inspector general shall have the power to revoke any reserve13
investigator's appointment at any time.14
E. Reserve investigators' appointments shall be valid only for a period15
of one year from the date of issuance; however, they may be renewed annually16
at the discretion of the inspector general.17
F. Upon the recommendation of the inspector general, each reserve18
investigator shall be eligible to apply to the superintendent of state police for a19
special officer's commission from the Louisiana Division of State Police under20
the applicable provisions of R.S. 40:1379.1.21
Section 2. This Act shall become effective upon signature by the governor22
or, if not signed by the governor, upon expiration of the time for bills to become law23
without signature by the governor, as provided in Article III, Section 18 of the24
Constitution of Louisiana. If vetoed by the governor and subsequently approved by25
the legislature, this Act shall become effective on the day following such approval.26 SB NO. 423

Present law provides that the office of the inspector general is designated as a law
enforcement agency and may employ persons whose responsibility is to conduct
investigations.
Proposed law provides that the office of the inspector general may employ former
investigators and law enforcement persons as reserve investigators if such persons have
maintained certification and graduated from a La. POST certified academy.
Proposed law provides that the inspector general will be authorized to issue a reserve
investigator's appointment to persons who have satisfied certain requirements of the office
of the inspector general.
Proposed law provides the inspector general the authority to revoke a reserve investigator's
appointment at any time.
Proposed law provides that reserve investigators will receive no compensation for his
participation in the reserve investigator program but will be reimbursed for their expenses
incurred during the course and scope of performing their official duties.
Proposed law provides that reserve investigators appointments will be for one year from the
date of issuance and may be renewed annually at the discretion of the inspector general.
Proposed law provides that upon recommendation by the inspector general, each reserve
investigator will be eligible to apply to the superintendent of state police for a special
officer's commission from the division of state police.
Effective upon signature of the governor or lapse of time for gubernatorial action.
