TEACHERS.  Repeals outdated provisions relative to public school teachers. (8/15/10)
AN ACT1
To repeal R.S. 17:16, 412, 418, and 426, relative to public school teachers; to repeal2
outdated provisions relative to the employment of retired teachers, the issuance of3
life certificates, the collection and report of statistics regarding aged and4
incapacitated teachers, and compulsory retirement of certain teachers; and to provide5
for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 17:16, 412, 418, and 426 are hereby repealed.8

Present law (R.S. 17:16)(Act 10, 1998 1

 E.S.) requires the State Board of Elementary and
Secondary Education to establish guidelines and procedures for local school boards to follow
when hiring retired teachers for the purpose of providing classroom instruction, before or
after school tutoring, or other instructional activities. Provides that such guidelines and
procedures shall:
1. Ensure retired teachers are qualified and trained to provide the instruction for which
they are hired to provide.
2. Encourage local school boards to use funds provided by the state for reading and
math programs in grades K-3, funds provided through the MFP, and other local, SB NO. 445

state, and federal funds to employ retired teachers for purposes of reducing the pupil-
teacher ratio for the teaching of reading and math in grades K-3, and for providing
instructional support to students in other grade levels in need of remediation.
Present law (R.S. 17:412)(Act 158, 1920; Act 213, 1932) authorizes the state board of
education to approve first grade or life certificates issued to teachers by the department of
education of any state in the U.S. and issue life certificates to teachers who have taught
satisfactorily for as many as 15 years in La. public schools.
Present law (R.S. 17:418)(Act 100, 1922) requires the state board of education to biennially
report statistics relative to aged and incapacitated public school teachers to the legislature.
Present law (R.S. 17:426)(Act 421, 1958) requires all teachers in the public schools in the
state who are not members of any publicly supported retirement system to be retired or
discontinue their employment at age 65. Allows a teacher who attains the age of 65 during
a school year to teach until the end of the school year. 
Proposed law repeals all provisions of present law enumerated above.
Effective August 15, 2010.
