MOTOR VEHICLES. Provides for the revocation of the hazardous materials endorsement
on a commercial driver's license for a person found guilty of reckless handling for a second
or subsequent violation.  (8/15/10)
AN ACT1
To enact R.S. 32:1518(C), relative to hazardous materials transportation and motor carrier2
safety; to provide relative to revocation of a hazardous materials endorsement on a3
commercial driver's license; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 32:1518(C) is hereby enacted to read as follows: 6
ยง1518.  Reckless handling of hazardous material7

C. The department shall revoke the hazardous material endorsement or9
"H" endorsement issued pursuant to the provisions of R.S. 32:408(B)(3)(d) for10
the commercial driver's license of any person upon a final judgment of11
conviction or assessment of a civil penalty for a second or subsequent violation12

DIGEST
Present law prohibits a person from offering or accepting for transportation, load or unload,
or transport, a hazardous waste or hazardous material defined in R.S. 32:1502, in a manner
that endangers or could endanger human life or health.
Present law provides that any person who willfully violates this Section shall, upon
conviction, be guilty of a felony and be fined or imprisoned pursuant to R.S. 32:1514(B) or
may be subject to a civil penalty pursuant to R.S. 32:1512(A).
Proposed law adds revocation of a hazardous material or "H" endorsement on a commercial
driver's license of any person upon conviction or final assessment of a civil penalty for a
second or subsequent offense for reckless handling of hazardous materials.
Effective August 15, 2010.
