Regular Session, 2010 ENROLLED SENATE BILL NO. 482 BY SENATOR LAFLEUR AN ACT1 To amend and reenact R.S. 48:601(A), to enact R.S. 48:601(E) and (F), and to repeal2 R.S. 48:601(D)(2)(c), relative to St. Landry Parish; to provide for the3 absorption of parish road districts upon creation of a new parishwide road4 district; to require the creation of certain drainage districts; and to provide for5 related matters.6 Notice of intention to introduce this Act has been7 published.8 Be it enacted by the Legislature of Louisiana:9 Section 1. R.S. 48:601(A) is hereby amended and reenacted, and R.S.10 48:601(E) and (F) are hereby enacted to read as follows: 11 ยง601. St. Landry Parish Road District12 A. Notwithstanding any provision of law to the contrary, specifically13 R.S. 48:573 and R.S. 48:590, the governing authority of St. Landry Parish is14 hereby authorized to establish a road district, and such district shall become15 effective upon approval by a majority of the registered voters of St.16 Landry Parish voting on the proposition at an election held for that17 purpose in accordance with the Louisiana Election Code. which The18 district shall be comprised of St. Landry Parish in its entirety.19 * * *20 E.(1) Notwithstanding any provision of law to the contrary, upon21 SB NO. 482 ENROLLED Page 2 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. the district becoming effective, the parish road districts created pursuant1 to R.S. 48:600, 600.1, 600.2, 600.3 and 600.4 shall be absorbed into the2 district and shall be subject to the provisions of this Section.3 (2) The district shall be the successor to any district absorbed4 pursuant to this Subsection. All unfinished business, documents, liens5 against property for unpaid taxes, money, movable, and immovable6 property, and books and records of the absorbed road districts shall be7 transferred to and become the responsibility and property of the district.8 Any legal proceeding to which the district is a party and which is filed,9 initiated, or pending before any court on the effective date of abolition10 and all documents involved in or affected by said legal proceeding shall11 retain their effectiveness and shall be continued in the name of the12 district. All obligations of the absorbed districts shall become the13 obligations of the St. Landry Parish Road District.14 (3) Until such time as the district proposes a parish wide tax and15 it is approved by voters as provided in Subsection D, the district shall16 continue to levy the ad valorem and sales taxes authorized by the17 electorate of each former district, and the revenues generated in each18 former district must be utilized for benefit of that former district.19 F. Notwithstanding any other provision of law to the contrary,20 upon the district becoming effective, the parish governing authority shall21 create drainage districts having boundaries coterminous with the22 boundaries of the road districts being absorbed. Such drainage districts23 shall have all the powers provided by law to construct, acquire, operate24 and maintain drainage facilities in their respective districts.25 Section 2. R.S. 48:601(D)(2)(c)is hereby repealed.26 Section 3. This Act shall become effective upon the first date to occur among27 the following: (1) the signature of the governor or, if not signed by the governor,28 upon expiration of the time for bills to become law without signature by the29 governor, as provided by Article III, Section 18 of the Constitution of Louisiana, or30 SB NO. 482 ENROLLED Page 3 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions.
