(gov sig) AN ACT1 To amend and reenact R.S. 44:4.1(B)(10) and (25), relative to public records; to provide2 relative to exceptions to public records law for certain records; and to provide for3 related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 44:4.1(B)(10) and (25) are hereby amended and reenacted to read as6 follows: 7 ยง4.1. Exceptions8 * * *9 B. The legislature further recognizes that there exist exceptions, exemptions,10 and limitations to the laws pertaining to public records throughout the revised11 statutes and codes of this state. This Act shall become effective upon signature by the governor or, if not4 signed by the governor, upon expiration of the time for bills to become law without signature5 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Clement, Jr. DIGEST Kostelka (SB 515) Present law provides exceptions to public records law for certain records. Proposed law retains present law and further provides exceptions for records of insurance fraud investigations by the section of insurance fraud within the Dept. of Insurance and for confidential reports filed by agency heads with the Board of Ethics concerning any matter that the agency head believes may constitute a violation of the ethics code, which reports are provided for in present law. Effective upon signature of the governor or lapse of time for gubernatorial action. (Amends R.S. 44:4.1(B)(10) and (25)) Summary of Amendments Adopted by Senate Committee Amendments Proposed by Senate Committee on Senate and Governmental Affairs to the original bill. 1. Adds exception for certain reports filed by agency heads with the Board of Ethics. 2. Changes effective date from August 15, 2010 to effective upon signature of the governor.
