CRIMINAL RECORDS. Adds offenses to list of crimes requiring DNA collection for
inclusion in the state DNA database. (8/15/10)
AN ACT1
To amend and reenact R.S. 15:603(10), relative to DNA detection of sexual and violent2
offenders; to provide for the collection of DNA samples from certain offenders; to3
provide for certain crimes requiring the collection of DNA samples; and to provide4
for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 15:603(10) is hereby amended and reenacted to read as follows: 7
ยง603.  Definitions8
For purposes of this Chapter, the following terms shall have the following9
meanings:10

(10) "Other specified offense" means a commission of the following:12
(a) A violation of R.S. 14:34.2 through 34.5.13
(b) A violation of R.S. 14:35 through 37.14
(c) A violation of R.S. 14:37.3.15
(d) A violation of R.S. 14:38.16

Present law provides for DNA samples to be taken for the following offenses: battery of a
police officer; battery of a school teacher; battery of a school or recreation athletic contest
official; battery of a correctional facility employee; simple battery; simple battery of a child
welfare worker; simple battery of the infirm; aggravated assault; unlawful use of a laser on
a police officer; simple assault; assault on a school teacher; stalking; misdemeanor carnal
knowledge of a juvenile; prostitution; soliciting for prostitutes; inciting prostitution;
prostitution by massage; massage, sexual conduct prohibited; letting premises for
prostitution; letting premises for obscenity; and peeping tom.
Proposed law maintains present law and provides for the following offense to be added to
the list of other specified crimes: identity theft; prohibited sexual conduct between educator
and student; contributing to the delinquency of juveniles; inciting a riot; and hate crimes.
Effective August 15, 2010.
