Regular Session, 2010 SENATE BILL NO. 603 BY SENATOR MORRISH STATE TREASURER. Transfers the powers and duties of the state treasurer and the Department of Treasury. (See Act) AN ACT1 To amend and reenact R.S. 49:150.1(C), 206, and 301, relative to the transfer of the powers2 and duties of the state treasurer and the Department of the Treasury; and to provide3 for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 49:150.1(C), 206, and 301 are hereby amended and reenacted to read6 as follows: 7 §150.1. State capitol complex; allocation of space; maintenance; law enforcement8 officer and firefighter memorial 9 * * *10 C. In addition to the provisions of Subsection B herein, four floors of the state11 capitol building shall be designated for use by the attorney general and one floor of12 the state capitol building shall be designated for use by the treasurer and the13 secretary of state. Temporary absence of governor and lieutenant governor, order of those who4 shall act as governor5 When both the governor and the lieutenant governor are temporarily absent6 from the state at the same time and neither can be contacted as a result of the7 existence of an emergency situation, the official whose title appears first in the8 following list and who is present in the state shall act as governor to maintain the9 necessary continuity of state government:10 (1) The elected secretary of state;11 (2) The elected attorney general;12 (3) The elected treasurer;13 (4) (3) The presiding officer of the Senate; and14 (5) (4) The presiding officer of the House of Representatives.15 * * *16 §301. Commission and oath17 For purposes of this Title, the terms "treasurer" or "state treasurer"18 shall mean the secretary of state except where the context clearly indicates19 otherwise. The state treasurer shall be commissioned by the governor and before20 entering upon the discharge of the duties of his office, shall take and subscribe the21 oath prescribed by the constitution, which shall be indorsed on his commission. His22 commission shall not be issued by the governor until the bond and surety shall have23 been given.24 Section 2. Proposed law provides that for purposes of present law and proposed law the terms "treasurer" or "state treasurer" means the secretary of state except where the context clearly indicates otherwise. Proposed law transfers the powers and duties of the state treasurer to the secretary of state. Proposed law provides that proposed law becomes effective only if the proposed constitutional amendment that originated as Senate Bill 95 of the 2010 Regular Session of the Legislature is approved by the electorate.
