TRAFFIC.  Provides relative to speed limits on highways. (8/15/10)
AN ACT1
To enact R.S. 32:61(A)(3) and R.S. 32:63(C); and to repeal R.S. 32:62, relative to speed2
limits on highways of this state; to authorize increases of the maximum speed on3
highways; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 32:61(A)(3) and R.S. 32:63(C) are hereby enacted to read as follows:6
§61.  Maximum speed limit7
A.  No person shall operate a vehicle on any highway of this state in excess8
of fifty-five miles per hour, unless a lower maximum speed is posted on the highway,9
except as follows:10

(3) A person may operate a vehicle in excess of any maximum speed set12
forth in this Chapter within a speed zone established by the department as13
provided in R.S. 32:63(C).14

C. The department may establish a speed zone and may determine and1
declare a speed in excess of any maximum speed set forth in this Chapter within2
such speed zone on any highway of this state, whenever the department shall3
determine on the basis of an engineering and traffic investigation that such4
speed is reasonable and safe. The department shall erect appropriate signs5
giving notice thereof.6
Section 2.  R.S. 32:62 is hereby repealed.7

Present law provides maximum speed limits on highways of this state.
Present law authorizes establishment of speed zones.
Proposed law authorizes operation of vehicles in excess of any maximum speed set forth
present law within a speed zone established by the department as provided in the proposed
law set forth below.
Proposed law authorizes the Department of Transportation and Development to establish a
"speed zone". Provides that the department may determine and declare a speed in excess of
the maximum speed set forth present law within such speed zone whenever the department
determines on the basis of an engineering and traffic investigation that such speed is
reasonable and safe. Further provides that the department shall erect appropriate signs
giving notice of the speed zone.
Proposed law repeals maximum speed limits for certain vehicles.
Effective August 15, 2010.
(Adds R.S. 32:61(A)(3) and R.S. 32:63(C); repeals R.S. 32:62)
