GAMING. Permits certain electronic gaming devices in certain eligible facilities. (8/15/10)
AN ACT1
To amend and reenact R.S. 27:364(A)(1)(b)(v), relative to the Gaming Control Board; to2
provide for powers and duties; to permit certain gaming devices at eligible facilities;3
and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 27:364(A)(1)(b)(v) is hereby amended and reenacted to read as6
follows: 7
§364. Gaming Control Board; powers and duties8
A. The board shall:9

(b) Such rules shall include:11

(v)(i) A prescription of the types of slot machines which may be operated13
and the games which may be permitted on such machines. No game may be14
permitted on such machines by prescription of the board which resembles a game the15
play of which requires, or typically includes, the participation of another natural16

(ii) The prescription contained in R.S. 27:364(A)(1)(b)(v)(i) concerning1
games that require, or typically include, the participation of another person,2
shall not apply to the acquisition and deployment of any games, or devices, that3
fit the classification of an electronic gaming device (EGD), as determined by the4
Louisiana Gaming Control Board and/or their designated gaming certification5
lab, in the slot facility currently operated by a facility located in a parish with6
a population in excess of two hundred seventy–five thousand according the7
latest federal decennial census. The devices of this nature acquired by that8
facility shall in no way expand the number of electronic gaming devices9
authorized by law for that facility.10
(iii) Notwithstanding the language of the exemption in R.S.11
27:364(A)(1)(b)(v)(ii), no game simulating the card game commonly designated12
as, "Poker," or any variation thereof, (excluding the card game commonly13
referred to as "Black Jack," or "21") shall be permitted in that facility.14

DIGEST
Present law provides for powers and duties of the La. Gaming Control Board.
Present law authorizes the board to adopt rules necessary to implement, administer and
regulate slot machine gaming. Provides that such rules shall include a prescription of the
types of slot machines which may be operated and the games which may be permitted.
Present law specifically prohibits the board from adopting a rule authorizing a game of play
which requires, or typically includes, the participation of another natural person.
Proposed law provides that notwithstanding present law, the prescription concerning games
that require, or typically include, the participation of another person, shall not apply to the
acquisition and deployment of any games, or devices, that fit the classification of an
electronic gaming device(EGD), as determined by the board and/or their designated gaming
certification lab, in the slot facility currently operated by a facility located in a parish with
a population in excess of 275,000 according the latest federal decennial census. The devices
of this nature acquired by that facility shall in no way expand the number of electronic
gaming devices authorized by law for that facility.  Further, no game simulating the card
game commonly designated as, "Poker," or any variation thereof, (excluding the card game
commonly referred to as "Black Jack," or "21") shall be permitted in that facility. SB NO. 640
