AN ACT1
To enact R.S. 30:2040.1, relative to environmental quality; to provide relative to the siting2
of certain solid waste disposal facilities near the Acadiana Regional Airport; to3
provide terms and conditions; and to provide for related matters.4
Notice of intention to introduce this Act has been published.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 30:2040.1 is hereby enacted to read as follows: 7
ยง2040.1. Siting disposal facilities near Acadiana Regional Airport8
The secretary shall not authorize or permit a residential or commercial9
solid waste disposal facility or a construction and demolition debris solid waste10
disposal facility within ten thousand feet of the Acadiana Regional Airport11
operations area if such facility will not be in compliance with local zoning12
ordinances. Such zoning ordinances shall comply with any United States13
Department of Transportation, Federal Aviation Administration order,14
regulation, circular, safety guideline, recommendation, or other official15
document pertaining to aviation safety and land use.16
