SENATE BILL NO. 687
BY SENATOR HEBERT 
LIABILITY INSURANCE. Increases the minimum amount of property damage insurance
required for a public carrier vehicle from $5,000 to $25,000.  (8/15/10)
AN ACT1
To amend and reenact R.S. 45:200.4, relative to public carrier vehicle insurance; to increase2
the minimum amount of insurance for property damage; and to provide for related3
matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 45:200.4 is hereby amended and reenacted to read as follows: 6
ยง200.4.  Insurance of each public carrier vehicle7
No such certificate shall be issued until the owner of the public carrier8
vehicle shall first have filed with the duly designated authority of the municipality9
or parish in which such operation is permitted, a policy of liability insurance issued10
by an insurance company authorized to do business in this state.  Said insurance11
policy shall provide for payment of a sum not less than twenty-five thousand dollars12
to satisfy all claims for damages by reason of bodily injury to, or death of, any one13
person resulting from any one accident, and, subject to said limit for one person, for14
payment of a sum not less than fifty thousand dollars to satisfy all claims for15
damages by reason of bodily injury to, or death of, two or more persons, resulting16
from any one accident, and for payment of a sum not less than five twenty-five17 SB NO. 687

thousand dollars to satisfy all claims for damage to property resulting from any one1
accident, by reason of the ownership, operation, maintenance or use of such vehicle2
upon any street.3

DIGEST
Present law defines a public carrier vehicle as any motor vehicle with a normal seating
capacity of less than 10 passengers that is used for the transportation of passengers for hire
over any streets by a route or to a destination controlled by the passenger.  Requires the
owner of a public carrier vehicle to obtain a certificate of public necessity and convenience
from a municipal or parochial authority.  	Proposed law retains present law.
Present law requires that in order to receive a certificate, the owner first must obtain a policy
of liability insurance, which includes property damage for at least $5,000.  Proposed law
increases the minimum requirements for property damage insurance 	from $5,000 to $25,000.
Effective August 15, 2010.
