COLLEGES/UNIVERSITIES. Provides limitation of liability for LAICU and member
institutions if confidential student information they are required to submit to the Board of
Regents is breached as the result of board actions. (8/15/10)
AN ACT1
To enact R.S. 17:1814, relative to postsecondary education; to provide limitation of liability2
for breaches of certain confidential student information submitted to the Board of3
Regents by nonpublic postsecondary educational institutions; and to provide for4
related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 17:1814 is hereby enacted to read as follows: 7
ยง1814. Nonpublic postsecondary educational institutions; submission of8
required data; limitation of liability9
A. When the Louisiana Association of Independent Colleges and10
Universities, or any of its member institutions, are required by law or by rule11
or regulation to provide to the Board of Regents confidential student data or12
records concerning students enrolled in Louisiana Association of Independent13
Colleges and Universities member institutions, neither the Louisiana14
Association of Independent Colleges and Universities, nor any member15
institution thereof, shall be held liable in any court of law for any breach of16
confidentiality of such information, provided the breach resulted from actions17 SB NO. 713

of the Board of Regents or its staff and not from the transmission of the data or1
records by the Louisiana Association of Independent Colleges and Universities2
or any of its member institutions prior to the receipt of such data or records by3
the board.4
B. The provisions of this Section shall apply to any student data or5
records that are confidential under state or federal law, including, but not6
limited to, the federal Family Educational Rights and Privacy Act of 1974.7

DIGEST
Proposed law provides that the La. Association of Independent Colleges and Universities
(LAICU) and its member institutions are not liable if any confidential student data or records
they are required to submit to the Board of Regents is breached as the result of actions of the
board or its staff and not from the transmission of such data or records by LAICU or a
member institution prior to receipt by the board. Further provides that proposed law applies
to any student data or records that are confidential under any state or federal law, including
the federal Family Educational Rights and Privacy Act.
