COLLEGES/UNIVERSITIES. Provides limitation of liability for LAICU and member
institutions if confidential student information they submit to the Board of Regents is
breached as the result of board actions. (8/15/10)
AN ACT1
To enact R.S. 17:1814, relative to postsecondary education; to provide limitation of liability2
for breaches of certain confidential student information submitted to the Board of3
Regents by nonpublic postsecondary educational institutions; and to provide for4
related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 17:1814 is hereby enacted to read as follows: 7
ยง1814. Nonpublic postsecondary educational institutions; submission of8
required data; limitation of liability9
A. When the Louisiana Association of Independent Colleges and10
Universities, or any of its member institutions, provide to the Board of Regents11
confidential student data or records concerning students enrolled in Louisiana12
Association of Independent Colleges and Universities member institutions,13
pursuant to a law, rule, or regulation, neither the Louisiana Association of14
Independent Colleges and Universities, nor any member institution thereof,15
shall be held liable in any court of law for any breach of confidentiality of such16
information, provided the breach resulted from actions of the Board of Regents17 SB NO. 713

or its staff and not from the transmission of the data or records by the1
Louisiana Association of Independent Colleges and Universities or any of its2
member institutions prior to the receipt of such data or records by the board.3
B. The provisions of this Section shall apply to any student data or4
records that are confidential under state or federal law, including, but not5
limited to, the federal Family Educational Rights and Privacy Act of 1974.6

Proposed law provides that the La. Association of Independent Colleges and Universities
(LAICU) and its member institutions are not liable if any confidential student data or records
they submit to the Board of Regents pursuant to a law, rule, or regulation, is breached as the
result of actions of the board or its staff and not from the transmission of such data or
records by LAICU or a member institution prior to receipt by the board. Further provides
that proposed law applies to any student data or records that are confidential under any state
or federal law, including the federal Family Educational Rights and Privacy Act.
Effective August 15, 2010.
