AN ACT1
To enact R.S. 17:1814, relative to postsecondary education; to provide limitation of liability2
for breaches of certain confidential student information submitted to the Board of3
Regents by nonpublic postsecondary educational institutions; and to provide for4
related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 17:1814 is hereby enacted to read as follows: 7
ยง1814. Nonpublic postsecondary educational institutions; submission of8
required data; limitation of liability9
A. When the Louisiana Association of Independent Colleges and10
Universities, or any of its member institutions, provide to the Board of Regents11
confidential student data or records concerning students enrolled in Louisiana12
Association of Independent Colleges and Universities member institutions,13
pursuant to a law, rule, or regulation, neither the Louisiana Association of14
Independent Colleges and Universities, nor any member institution thereof,15
shall be held liable in any court of law for any breach of confidentiality of such16
information, provided the breach resulted from actions of the Board of Regents17
or its staff and not from the transmission of the data or records by the18
Louisiana Association of Independent Colleges and Universities or any of its19
member institutions prior to the receipt of such data or records by the board.20

B. The provisions of this Section shall apply to any student data or1
records that are confidential under state or federal law, including, but not2
limited to, the federal Family Educational Rights and Privacy Act of 1974.3
