AN ACT1
To amend and reenact R.S. 24:653(H)(2), relative to the Joint Legislative Committee on the2
Budget; to provide for the review of certain negotiations, compromises or3
settlements by the Litigation Subcommittee of the Joint Legislative Committee on4
the Budget; to provide for an effective date; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 24:653(H)(2) is hereby amended and reenacted to read as follows:7

(2) No person on behalf of the state or any of its departments or agencies11
or employees nor any attorney representing the state or any of its departments or12
agencies or any of its employees entitled to indemnification under R.S. 13:5108.1 or13
R.S. 13:5108.2 shall sign any negotiation, agreement, compromise or settlement14
which obligates the state to pay more than one million dollars without prior15
consultation with the attorney general and the members of the litigation16
subcommittee of the Joint Legislative Committee on the Budget.17 SB NO. 749

Section 2. This Act shall become effective on July 1, 2010; if vetoed by the governor2
and subsequently approved by the legislature, this Act shall become effective on July 1,3
2010, or on the day following such approval by the legislature, whichever is later.4

Present law provides that the Joint Legislative Committee on the Budget shall have a
litigation subcommittee and further provides that no attorney representing the state or any
of its departments or agencies or any of its employees entitled to indemnification under R.S.
13:5108.1 (indemnification of officers and employees of the state, civil rights, and
representation by the attorney general) shall sign any compromise or settlement which
obligates the state to pay more than $1,000,000 without prior consultation with the attorney
general and the members of the litigation subcommittee.
Proposed law retains present law and further prohibits any person on behalf of the state or
any of its departments or agencies or employees from signing any negotiation, agreement,
compromise or settlement which obligates payment by the state without prior consultation
with the attorney general and the members of the litigation subcommittee.
Effective July 1, 2010.
