BY SENATOR MCPHERSON 
MOTOR VEHICLES. Provides that last titled owner is responsible for costs assessed to tow
and store an abandoned motor vehicle. (8/15/10)
AN ACT1
To enact R.S. 32:473.1(D) and (E), relative to motor vehicles; to provide for the2
presumption of responsibility for an abandoned motor vehicle; to provide for the3
towing and storage of an abandoned motor vehicle; and to provide for related4
matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 32:473.1(D) and (E) are hereby enacted to read as follows: 7
ยง473.1. Abandoned vehicle; removal8

D. It shall be presumed that the last titled owner of the motor vehicle is10
responsible for the abandoned motor vehicle unless such owner provides11
adequate proof of sale of the abandoned motor vehicle. The last titled owner of12
the motor vehicle shall be responsible for all costs assessed for the towing and13
storage of the abandoned motor vehicle, unless adequate proof of sale is14
provided to the office of motor vehicles.15
E. Removal of an abandoned vehicle in accordance with this Section by16
a tow truck operator shall not be considered a rotation call by the appropriate17 SB NO. 768

law enforcement agency as set forth in R.S. 32:1735(C). The tow truck operator1
shall not lose its place in the rotation call list for the recovery of an abandoned2
motor vehicle in accordance with this Section.3

DIGEST
Present law provides the procedure in removing an abandoned motor vehicle.
Proposed law provides the last titled owner of the motor vehicle is presumed responsible
for an abandoned motor vehicle and will be responsible for all costs assessed for towing and
storing the abandoned motor vehicle, unless adequate proof of sale is provided to the office
of motor vehicles.
Proposed law provides that a tow truck operator called by the appropriate law enforcement
agency to remove an abandoned motor vehicle will not lose its place in the rotation call list
for such a recovery.
Proposed law otherwise retains present law.
Effective August 15, 2010.
