BY SENATOR MCPHERSON 
MOTOR VEHICLES. Provides that a tow truck operator called by a law enforcement
agency to remove an abandoned motor vehicle will not lose its place in the rotation call list.

AN ACT1
To enact R.S. 32:473.1(D), relative to motor vehicles; to provide relative to the rotation call2
list in connection with removal of an abandoned motor vehicle; and to provide for3
related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 32:473.1(D) is hereby enacted to read as follows: 6

D. Removal of an abandoned motor vehicle in accordance with this9
Section by a tow truck operator shall not be considered a rotation call by the10
appropriate law enforcement agency as set forth in R.S. 32:1735(C). The tow11
truck operator shall not lose its place in the rotation call list for the recovery of12
an abandoned motor vehicle in accordance with this Section. Law enforcement13
agencies shall maintain records of the number of abandoned motor vehicles14

Present law provides the procedure in removing an abandoned motor vehicle.
Proposed law provides that a tow truck operator called by the appropriate law enforcement
agency to remove an abandoned motor vehicle will not lose its place in the rotation call list
for such a recovery. Also requires law enforcement agencies to maintain records of the
number of abandoned motor vehicles removed.
Effective August 15, 2010.

Summary of Amendments Adopted by Senate
Committee Amendments Proposed by Senate Committee on Transportation,
Highways, and Public Works to the original bill.
1. Deletes provision making the last titled owner of the motor vehicle
presumptively responsible for the abandoned motor vehicle and for towing
and storage costs unless adequate proof of sale was provided to the office of
motor vehicles.
2. Requires law enforcement agencies to maintain records of the number of
abandoned motor vehicles removed
