REAPPORTIONMENT/PSC:  Provides with respect to the Public Service Commission
districts (Item #5)
AN ACT1
To amend and reenact R.S. 45:1161.4, relative to redistricting; to provide for election2
districts for the Public Service Commission; to provide for election of3
commissioners; to provide for effectiveness; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 45:1161.4 is hereby amended and reenacted to read as follows:6
ยง1161.4.  Public Service Commission districts7
A. The state shall be divided into the following five Public Service Commission8
districts and one commissioner shall be elected from each district:9
(1) District No. Number 1 is composed of Precincts 4, 5, 12, 13, 14, 15, 18, 21, 22,10
26, 27, 35, and 41 of Ascension Parish; Precincts 1, 2, 3, 4, 5, 7, 8, 9, 10, 11, 12, 13, 14, 15,11
16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40,12
41, 42, 43, 44, 45, 46, 51, 52, 53, 54, 55, 56, 58, 59, 60, 61, 62, 63, 64, 65, 66, 67, 68, 69, 70,13

B. Each commissioner in office on the effective date of this Section* Section shall25
be the commissioner for the district having the same designation as the district from which26

C. The successors of the commissioners in office on the effective date of this1
Section* shall be elected from the following districts at the congressional elections in the2
year designated and every six years thereafter:3
(1)  The first district in 2002.4
(2)  The second district in 2006.5
(3)  The third district in 2004.6
(4)  The fourth district in 2004.7
(5)  The fifth district in 2002.8
Section 2. The territorial limits of the districts of the Public Service Commission9
shall be as provided in Act No. 2 of the 2001 Second Extraordinary Session of the10
Legislature, and such territorial limits shall continue in effect without change.11
Section 3. The provisions of this Act shall not reduce the term of office of any12
commissioner of the Public Service Commission holding office on the effective date of this13
Section.14
Section 4. Any election after the effective date of this Section to fill a vacancy in the15
office of a commissioner of the Public Service Commission for the remainder of the term16
shall be conducted in the district where the vacancy has occurred as such district is17
designated and composed as provided in Section 1 of this Act.18
Section 5.(A) Section 1 of this Act shall become effective solely for the purposes of19
qualifying and election of members of the Public Service Commission at the regularly20
scheduled elections in 2012, upon signature of this Act by the governor or, if not signed by21
the governor, upon expiration of the time for bills to become law without signature by the22
governor, as provided in Article III, Section 18 of the Constitution of Louisiana. If this Act23
is vetoed by the governor and subsequently approved by the legislature, Section 1 of this Act24
shall become effective for such purposes on the day following such approval.  The25
provisions of Section 1 of this Act shall be effective for all other purposes on January 1,26
2013.27
(B)  Section 4 of this Act shall become effective at noon on January 1, 2013.28 HLS 111ES-43	ORIGINAL

(C) The provisions of this Section and Sections 2 and 3 of this Act shall become1
effective upon signature of this Act by the governor or, if not signed by the governor, upon2
expiration of the time for bills to become law without signature by the governor, as provided3
in Article III, Section 18 of the Constitution of Louisiana. If this Act is vetoed by the4
governor and subsequently approved by the legislature, the provisions of this Section and5
Section 2 of this Act shall become effective on the day following such approval.6

Present law divides the state into five districts for election of commissioners to the Public
Service Commission (PSC). Proposed law retains present law and makes technical
corrections.
Proposed law provides that the Act shall not reduce the term of office of any member of the
PSC.
Proposed law provides that each commissioner in office on the effective date of the Act shall
be the commissioner for the district having the same designation as the district from which
the commissioner was elected and that each commissioner in office shall complete the term
for which he was elected. Provides that a vacancy in the representation of any PSC district
which is filled after the effective date of the Act shall be filled as provided by law from the
district where the vacancy occurs as it is designated and composed in the Act.
Proposed law specifies that the territorial limits of the districts of the PSC shall be as
provided in Act No. 2 of the 2001 2nd E.S. of the Legislature, and such territorial limits shall
continue in effect without change.
