SENATE BILL NO. 13
BY SENATOR MURRAY 
CENSUS. Provides relative to provisions in Title 8 which are limited in applicability to
political subdivisions or local areas meeting specified population characteristics.
AN ACT1
To amend and reenact R.S. 8:308(B), relative to provisions of Title 8 (Cemeteries) of the2
Louisiana Revised Statutes of 1950, which are limited in applicability to certain3
political subdivisions or local areas based upon population classifications; to specify4
applicability to one or more political subdivisions or local areas; and to provide for5
related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 8:308(B) is hereby amended and reenacted to read as follows: 8
ยง308.  Sale of cemetery spaces; abandoned spaces, defined, sale9

B. In the event that any of the interment spaces in municipal, religious , and11
nonprofit cemeteries, in any parish the population of which is five hundred thousand12
or greater the city of New Orleans has been abandoned as defined in Paragraph C13
hereof Subsection C of this Section for more than a period of ten years, then a14
cemetery authority managing the cemetery in which such space is located, after15
advertising in the official journal of the parish or municipality wherein such16
cemetery is located city of New Orleans a notice attesting to such fact, may take17 SB NO. 13

possession of but not demolish such abandoned interment spaces and sell and convey1
same subject to rules and regulations as set forth in Paragraph A Subsection A of2
this Section.3

legislates with regard to classifications of parishes, municipalities, or other political
subdivisions or local areas according to population by enacting local bills to limit the
application of laws based upon specific classifications to one or more parishes,
municipalities, or other political subdivisions or local areas, by adjusting the population
ranges affected by the 2010 census, and by repealing certain provisions based upon certain
population classification ranges, as follows:
