FUNDS/FUNDING: Provides relative to deposits into the State Highway Improvement Fund AN ACT1 To amend and reenact R.S. 47:481 and R.S. 48:196(A)(introductory paragraph), relative to2 registration and license fees; to provide for the disposition of collections into certain3 accounts; to provide for monies to be deposited into the State Highway Improvement4 Fund; to provide for an effective date; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 47:481 is hereby amended and reenacted to read as follows:7 §481. Disposition of collections8 Except as provided in R.S. 47:480, all fees and taxes provided for in this9 Chapter, including the permit fees, shall be paid to the state treasurer on or before the10 tenth day of each month following their collection and shall be credited to the11 account of the state general fund, the Transportation Trust Fund, the State Highway12 Improvement Fund, and the state highway fund No. 2, as provided by law.13 Section 2. R.S. 48:196(A)(introductory paragraph) is hereby amended and reenacted14 to read as follows: 15 §196. State Highway Improvement Fund16 A. There is hereby created, as a special fund in the state treasury, the State17 Highway Improvement Fund, hereinafter referred to as the "fund". Beginning July 1, 2007, and each fiscal year thereafter, after compliance1 with the requirements of Article VII, Section 9(B) of the Constitution of Louisiana,2 and after making the allocation for state highway fund No. 2, the treasurer shall3 deposit into the fund the following amounts:4 * * *5 Section 3. [R.S. 1:13(B) and 24:177(E)] Lambert HB No. 238 Abstract: Deletes reference to deposits of motor vehicle registration fees into the state general fund and deletes limitation to trucks and trailers of certain fees deposited into the State Highway Improvement Fund. Present law provides that fees and taxes provided for in present law, including the permit fees, shall be credited to the account of the state general fund, the Transportation Trust Fund, the State Highway Improvement Fund, and the state highway fund No. 2, as provided by law. Proposed law deletes the reference in present law to the state general fund. Present law provides for the State Highway Improvement Fund. Monies in the fund are to be used exclusively by the Dept. of Transportation and Development for funding projects for roads in the state highway system which are ineligible for federal funds. Proposed law retains present law. Present law provides that the source of monies in the fund shall be registration and license fees and taxes on trucks and trailers collected by the state pursuant to R.S. 47:462, and as provided in R.S. 47:481. Proposed law removes the restriction that only the license fees on trucks and trailers are deposited in the fund. Effective July 1, 2012. (Amends R.S. 47:481 and R.S. 48:196(intro. para.))
