HOMELAND SECURITY: Provides relative to the creation of a statewide planning and mapping system for public buildings AN ACT1 To enact R.S. 29:726.3, relative to the Louisiana Homeland Security and Emergency2 Assistance and Disaster Act; to provide for the development, operation, and3 maintenance of a critical incident planning and mapping system; to provide for4 responsibilities of the Governor's Office of Homeland Security and Emergency5 Preparedness; to require that certain entities provide critical information to be6 included in the system; to provide definitions; and to provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 29:726.3 is hereby enacted to read as follows: 9 ยง726.3. Critical Incident Planning and Mapping System10 A. To the extent that sufficient funds are appropriated to implement the11 provisions of this Section, the Governor's Office of Homeland Security and12 Emergency Preparedness shall develop, operate, and maintain a statewide critical13 incident planning and mapping system for all public buildings in this state to assist14 first responders when responding to a disaster or emergency.15 B. The Governor's Office of Homeland Security and Emergency16 Preparedness shall create, develop, or acquire a computer system and software that17 has the capability to do the following:18 (1) Store critical information as provided in Subsection C of this Section.19 HLS 11RS-196 ENGROSSED HB NO. 34 Page 2 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (2) Provide access to the critical information contained in the system to all1 first responders.2 C.(1) To the extent that sufficient funds are available to implement the3 provisions of this Section, the office of facility planning and control, division of4 administration, the governing authority of each local governmental subdivision, and5 the superintendent of each local school district shall provide to the Governor's Office6 of Homeland Security and Emergency Preparedness for inclusion in the system the7 following critical information for all public buildings located in this state:8 (a) Building floor plans.9 (b) Evacuation plans and other fire protection information relative to each10 state building.11 (c) Any known hazards associated with the building.12 (2) The information required by the provisions of Paragraph (1) of this13 Subsection shall be available to first responders to assist in the determination of the14 best approach when responding to an emergency or disaster, including but not15 limited to the determination of evacuation routes and strategies for evacuation,16 alarms and other signals or means of notification, plans for sheltering in place, and17 training and strategies for the prevention of attacks involving violence.18 D. The Governor's Office of Homeland Security and Emergency19 Preparedness shall adopt rules in accordance with the Administrative Procedure Act20 to implement the provisions of this Section. The rules shall provide for the21 following:22 (1) The manner by which the critical information required by the provisions23 of Subsection C of this Section shall be transferred to the system from the office of24 facility planning and control, division of administration, the governing authority of25 local governmental subdivisions, and school superintendents.26 (2) The format by which those entities shall transfer critical information for27 inclusion in the system.28 HLS 11RS-196 ENGROSSED HB NO. 34 Page 3 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (3) The standards and conditions for the use of the system by first1 responders.2 (4) The guidelines for the accessibility and confidentiality of information3 contained within the system.4 (5) A list of the priorities for the distribution of any funds which may be5 available to the entities eligible to participate in the system.6 (6) The guidelines for the training of persons on how to utilize the system.7 E. The Governor's Office of Homeland Security and Emergency8 Preparedness shall take such actions as are necessary and appropriate to secure9 private, state, federal, or other public funds for the development, operation, and10 maintenance of the statewide critical incident mapping and planning system. The11 Governor's Office of Homeland Security and Emergency Preparedness may accept12 gifts, grants, and other contributions for the development, operation, and13 maintenance of the system.14 F. Beginning on the first day of October 2011, the Governor's Office of15 Homeland Security and Emergency Preparedness shall provide to the legislature an16 annual report setting forth the progress of developing, operating, and maintaining the17 system.18 G. For purposes of this Section:19 (1) "Political subdivision" means any parish, city, town, village, special20 district, or school district.21 (2) "Public building" means any building used or owned by the state or any22 political subdivision of the state and shall include any building used by any public23 elementary and secondary school, college, or university.24 Section 2. This Act shall become effective upon signature by the governor or, if not25 signed by the governor, upon expiration of the time for bills to become law without signature26 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Requires GOHSEP to acquire a computer system and software that has the capability of storing critical information required by proposed law and grant access to that information to all first responders. Proposed law requires that certain entities provide critical information to GOHSEP for inclusion in the system and provides for the use of critical information by first responders. Proposed law requires GOHSEP to adopt rules in accordance with the APA to implement proposed law and provides that proposed law is contingent upon the appropriation of funds.
