HLS 11RS-904 ORIGINAL Page 1 of 3 Regular Session, 2011 HOUSE BILL NO. 353 BY REPRESENTATIVE ARNOLD DISTRICTS/HOSPITAL SERVC: Provides relative to the Parish Hospital Service District for the parish of Orleans AN ACT1 To reenact R.S. 46:1095(B)(1) and (C), relative to Orleans Parish; to provide relative to the2 Parish Hospital Service District for the parish of Orleans; to reenact provisions3 relative to the membership of the governing boards of the two areas of the district;4 and to provide for related matters.5 Notice of intention to introduce this Act has been published6 as provided by Article III, Section 13 of the Constitution of7 Louisiana.8 Be it enacted by the Legislature of Louisiana:9 Section 1. R.S. 46:1095(B)(1) and (C) are hereby reenacted to read as follows:10 ยง1095. Board of commissioners; membership; appointment; terms; compensation;11 removal12 * * *13 B. Each commission shall be composed as follows:14 (1) Seven members shall be appointed by the chief executive officer of the15 parish. Each commissioner shall demonstrate expertise in one or more of the16 following areas: medical litigation, fundraising and philanthropy, accounting,17 business development, indigent care, community relations, government relations,18 women's health, minority health, geriatric medicine, nursing, any other medical field,19 or consumer advocacy.20 * * *21 HLS 11RS-904 ORIGINAL HB NO. 353 Page 2 of 3 C.(1) The members serving pursuant to Paragraphs (B)(1) and (2) of this1 Section shall serve at the pleasure of the chief executive officer of the parish.2 (2) The members serving pursuant to Paragraphs (B)(3) through (7) of this3 Section shall serve during their terms of office.4 (3) Any vacancy in the membership of the commission occurring by reason5 of the expiration of term of office, death, resignation, disqualification, or otherwise6 shall be filled in the same manner as the original appointment within thirty days of7 such vacancy. If the appointing authority fails to fill the vacancy within thirty days8 of such vacancy, the remaining members of the commission shall appoint an interim9 successor to serve on the commission until the position is filled by the appointing10 authority.11 * * *12 Section 2. This Act shall become effective upon signature by the governor or, if not13 signed by the governor, upon expiration of the time for bills to become law without signature14 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. [R.S. 1:13(B) and 24:177(E)] Arnold HB No. 353 Abstract: Reenacts provisions relative to the members of the boards of commissioners of the two areas of the Parish Hospital Service District for the parish of Orleans. Present law (R.S. 46:1094) creates the Parish Hospital Service District for the parish of Orleans. Provides for the district's boundaries to be coterminous with the parish boundaries but divides the parish into two areas, each to be governed by a board of commissioners. The two areas are: (a) Orleans Parish east of the Industrial Canal and (b) all of Orleans Parish except the geographical areas east of the Industrial Canal and the area of Orleans Parish bounded by Earhart Boulevard, Carrollton Avenue, Loyola Avenue, and Iberville Street. Present law (R.S. 46:1095), relative to the boards of commissioners for each of the two areas, provides that each board be comprised of 13 members: seven members appointed by the parish chief executive officer; a consumer member appointed by the parish chief executive officer, all eight of whom to serve at the pleasure of the parish chief executive officer; and five specified ex officio members to serve during their terms in their respective offices.
