SOCIAL SERVICES DEPT: Provides relative to the Children's Trust Fund within the Dept.
of Children and Family Services
AN ACT1
To amend and reenact R.S. 46:2404(B)(2) and (G)(6) and to enact R.S. 46:2404(G)(9),2
relative to the Louisiana Children's Trust Fund Board; to provide for board3
membership; to provide for compliance standards; to provide for fiduciary duties of4
the board; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 46:2404(B)(2) and (G)(6) are hereby amended and reenacted and7
R.S. 46:2404(G)(9) is hereby enacted to read as follows: 8
ยง2404.  Louisiana Children's Trust Fund Board; created; membership9

B. The Louisiana Children's Trust Fund Board shall be composed of fifteen11
members as follows:12

(2) The assistant secretary of the office of children and family services14
director of the child welfare program of the Department of Children and Family15
Services.16

G.  The board shall:18

(6) Adopt the budget request for the board and present it to the office of1
children and family services Department of Children and Family Services, the2
executive budget office, and the Joint Legislative Committee on the Budget.3

(9) Comply, and require compliance by all grantees and subrecipients, with5
the following:6
(a) All applicable provisions of the Louisiana Administrative Code relative7
to contracts, procurement, and property.8
(b) All legislative audit and financial reporting requirements provided for in9
R.S. 24:513.10
(c)  Any provision of federal or state law applicable to the Department of11
Children and Family Services relative to uses and monitoring of federal funds.12
Section 2. This Act shall become effective upon signature by the governor or, if not13
signed by the governor, upon expiration of the time for bills to become law without signature14
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If15
vetoed by the governor and subsequently approved by the legislature, this Act shall become16
effective on the day following such approval.17

Abstract: Provides relative to the Children's Trust Fund within the Dept. of Children and
Family Services (DCFS).
Present law provides for the composition and duties of the La. Children's Trust Fund Board.
Proposed law changes one of two board members representing DCFS from the assistant
secretary of the office of children and family services to the director of the child welfare
program.
Proposed law, in providing for entities to which the board shall present its budget request,
removes reference to a specific office within DCFS and provides instead that the board
present the budget request to DCFS, with no office of the agency specified. Retains present
law relative to submission of the budget to the executive budget office and the Joint

Proposed law requires that the board and all grantees and subrecipients comply with the
following:
(1)All applicable provisions of the La. Administrative Code relative to contracts,
procurement, and property.
(2)All legislative audit and financial reporting requirements provided in present law
relative to the legislative auditor.
(3)Any provision of federal or state law applicable to DCFS relative to uses and
monitoring of federal funds.
Effective upon signature of governor or lapse of time for gubernatorial action.
