Community and Technial Colleges System Board of Supervisors to increase tuition and mandatory fee amounts at institutions under its supervision and management and permits the uniform imposition of tuition and mandatory fee amounts on a per credit hour basis AN ACT1 To enact R.S. 17:3351(A)(5)(b)(iii)(cc), to authorize the Board of Supervisors of2 Community and Technical Colleges to increase tuition and mandatory fee amounts3 at institutions under its supervision and management; to provide limitations; to4 provide applicability; to provide for implementation, including provisions for the5 uniform imposition of tuition and mandatory fee amounts on a per credit hour basis;6 to provide an effective date; and to provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 17:3351(A)(5)(b)(iii)(cc) is hereby enacted to read as follows:9 ยง3351. General powers, duties, and functions of college and university boards10 A. Subject only to the powers of the Board of Regents specifically11 enumerated in Article VIII, Section 5 of the Constitution of Louisiana, and as12 otherwise provided by law, each postsecondary system management board as a body13 corporate shall have authority to exercise power necessary to supervise and manage14 the day-to-day operations of institutions of postsecondary education under its15 control, including but not limited to the following:16 * * *17 (5)18 * * *19 HLS 11RS-440 ORIGINAL HB NO. 526 Page 2 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (b)1 * * *2 (iii)3 * * *4 (cc)(I) Notwithstanding the limitation provided by Subitem (aa) of this Item5 or any authority provided to the board by this Subparagraph and in accordance with6 Article VII, Section 2.1 of the Constitution of Louisiana, the Board of Supervisors7 of Community and Technical Colleges is authorized to increase the tuition amount8 and the mandatory fee amount applicable to resident students at community and at9 technical-community colleges under its supervision and management provided the10 total combined tuition and mandatory fee amounts for an academic year do not11 exceed the highest total combined tuition and mandatory fee amounts in effect for12 such students on July 1, 2011. Increases in tuition and mandatory fee amounts13 pursuant to this Subsubitem shall be effective beginning with the fall semester of the14 2011-2012 academic year and continuing thereafter. Additionally, the board may15 provide for the uniform imposition of tuition and mandatory fees amounts for16 students at community and at technical-community colleges under its supervision17 and management on a per credit hour basis.18 (II) Notwithstanding the limitation provided by Subitem (aa) of this Item or19 any authority provided to the board by this Subparagraph and in accordance with20 Article VII, Section 2.1 of the Constitution of Louisiana, the Board of Supervisors21 of Community and Technical Colleges is authorized to increase the tuition amount22 and the mandatory fee amount applicable to resident students at the Louisiana23 Technical College provided the total combined tuition and mandatory fee amounts24 do not exceed two thousand dollars for an academic year or comparable period of25 time. Any increase in amounts shall be implemented in such a manner that one-third26 of the increase shall be effective beginning with the fall semester of the 2011-201227 academic year and continuing thereafter, an additional one-third shall effective28 beginning with the fall semester of the 2012-2013 academic year and continuing29 HLS 11RS-440 ORIGINAL HB NO. 526 Page 3 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. thereafter, and the final one-third shall be effective beginning with the fall semester1 of the 2013-2014 academic year and continuing thereafter. Additionally, the board2 may provide for the uniform imposition of tuition and mandatory fee amounts for3 students at the Louisiana Technical College on a per credit hour basis.4 * * *5 Section 2. This Act shall become effective upon signature by the governor or, if not6 signed by the governor, upon expiration of the time for bills to become law without signature7 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. The board's authority relative to increases for students at community colleges and at technical-community colleges differs from the board's authority relative to increases for students at the La. Technical College. The increase in amounts at community colleges and at technical- community colleges are effective beginning with the fall semester of the 2011-2012 academic year; the increase in amounts at the La. Technical College is to be implemented in equal amounts over the next three academic years. Provides for waivers of an increase or increases in cases of financial hardship. Permits the board to provide for the uniform imposition of tuition and mandatory fee amounts for students on a per credit hour basis. Relative to the Board of Supervisors of Community and Technical Colleges and community colleges and technical-community colleges under the board's supervision and management: Proposed law authorizes the board (notwithstanding certain present law authority and limitations and in accordance with specified provisions in the state constitution) to increase the tuition amount and the mandatory fee amount applicable to resident students provided the total combined tuition and mandatory fee amounts for an academic year do not exceed the highest total combined tuition and mandatory fee amounts in effect for such students on July 1, 2011. Provides that amounts authorized in proposed law shall be effective beginning with the fall semester of the 2011-2012 academic year and continuing thereafter. Additionally permits to the board to provide for the uniform imposition of tuition and mandatory fee amounts for student on a per credit hour basis. Proposed law authorizes the board (notwithstanding certain present law authority and limitations and in accordance with specified provisions in the state constitution) to increase the tuition amount and the mandatory fee amount applicable to resident students provided the total combined tuition and mandatory fee amounts do not exceed $2,000 for an academic year or comparable period of time. Specifies that any increase in amounts shall be implemented over each of the next three academic years with 1/3 of the increase being effective beginning with the fall semester each year and continuing thereafter. Additionally permits the board to provide for the uniform imposition of tuition and mandatory fee amounts for students on a per credit hour basis. Present law (R.S. 17:3351(A)(5)(b)(v)) requires the board, prior to imposing an increase in tuition or mandatory fee amounts, to establish criteria for waivers of such increase or increases in cases of financial hardship. Provides that information about such waivers and the criteria and procedures for obtaining one shall be made available to all prospective students affected by the increase or increases in a timely manner such that the prospective student can be aware of the increase or increases and the availability of waivers thereto prior to the student having to make any final decision concerning attendance at the institution.
