GERMAIN AN ACT1 To enact R.S. 17:3351(A)(5)(b)(iii)(cc), to authorize the Board of Supervisors of2 Community and Technical Colleges to increase tuition and mandatory fee amounts3 at institutions under its supervision and management; to provide limitations; to4 provide applicability; to provide for implementation, including provisions for the5 uniform imposition of tuition and mandatory fee amounts on a per-credit-hour basis;6 to provide an effective date; and to provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 17:3351(A)(5)(b)(iii)(cc) is hereby enacted to read as follows:9 ยง3351. General powers, duties, and functions of college and university boards10 A. Subject only to the powers of the Board of Regents specifically11 enumerated in Article VIII, Section 5 of the Constitution of Louisiana, and as12 otherwise provided by law, each postsecondary system management board as a body13 corporate shall have authority to exercise power necessary to supervise and manage14 the day-to-day operations of institutions of postsecondary education under its15 control, including but not limited to the following:16 * * *17 (5)18 * * *19 (b)20 * * *21 (iii)22 * * *23 ENROLLEDHB NO. 526 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (cc)(I) Notwithstanding the limitation provided by Subitem (aa) of this Item1 or any authority provided to the board by this Subparagraph and in accordance with2 Article VII, Section 2.1 of the Constitution of Louisiana, the Board of Supervisors3 of Community and Technical Colleges is authorized to increase the tuition amount4 and the mandatory fee amount applicable to resident students at community and at5 technical-community colleges under its supervision and management provided the6 total combined tuition and mandatory fee amounts for an academic year do not7 exceed the highest total combined tuition and mandatory fee amounts in effect for8 such students on July 1, 2011. Increases in tuition and mandatory fee amounts9 pursuant to this Subsubitem shall be effective beginning with the fall semester of the10 2011-2012 academic year and continuing thereafter. Additionally, the board may11 provide for the uniform imposition of tuition and mandatory fees amounts for12 students at community and at technical-community colleges under its supervision13 and management on a per-credit-hour basis; however, total amounts charged on a14 per-credit-hour basis shall not exceed the maximum amounts for full-time status15 otherwise authorized by this Subsubitem.16 (II) Notwithstanding the limitation provided by Subitem (aa) of this Item or17 any authority provided to the board by this Subparagraph and in accordance with18 Article VII, Section 2.1 of the Constitution of Louisiana, the Board of Supervisors19 of Community and Technical Colleges is authorized to increase the tuition amount20 and the mandatory fee amount applicable to resident students at the Louisiana21 Technical College provided the total combined tuition and mandatory fee amounts22 do not exceed two thousand dollars for an academic year or comparable period of23 time. Any increase in amounts shall be implemented in such a manner that one-third24 of the increase shall be effective beginning with the fall semester of the 2011-201225 academic year and continuing thereafter, an additional one-third shall be effective26 beginning with the fall semester of the 2012-2013 academic year and continuing27 thereafter, and the final one-third shall be effective beginning with the fall semester28 of the 2013-2014 academic year and continuing thereafter. Additionally, the board29 may provide for the uniform imposition of tuition and mandatory fee amounts for30 ENROLLEDHB NO. 526 Page 3 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. students at the Louisiana Technical College on a per-credit-hour basis; however, total1 amounts charged on a per-credit-hour basis shall not exceed the maximum amounts2 for full-time status otherwise authorized by this Subsubitem.3 * * *4 Section 2. This Act shall become effective upon signature by the governor or, if not5 signed by the governor, upon expiration of the time for bills to become law without signature6 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
