TRANSPORTATION:  Requires child care facilities to ensure that no child is left in
unattended motor vehicles
AN ACT1
To enact R.S. 32:295.3.1, relative to motor vehicles; to require day care centers to monitor2
the transportation of children so that no child is left unattended in a motor vehicle;3
to require the Department of Children and Family Services to modify its Quality4
Start Child Care Rating System to contemplate day care facility compliance with5
monitoring requirements; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 32:295.3.1 is hereby enacted to read as follows:8
ยง295.3.1. Motor vehicles used to transport children; day care facilities; quality care9
rating system10
A. The loading and unloading of passengers on motor vehicles owned and11
operated by a day care center, as defined in R.S. 46:1403, to transport children shall12
be monitored as to ensure that no child is left unattended in the motor vehicle. Each13
day care facility shall maintain an accurate child occupancy roster that is located on14
the vehicle at the beginning and end of each route.  Employees of the child care15
facility shall use the roster to account for the location of each child so that no child16
is left unattended in the motor vehicle.17
B. The Department of Children and Family Services shall amend its rules18
and procedures applicable to the Quality Start Child Care Rating System to include19 HLS 11RS-932	ORIGINAL

in its assessment of the quality of care of child care facilities consideration for those1
facilities that meet or exceed the requirements of Subsection A of this Section.2

Proposed law requires day care centers to monitor the occupancy of motor vehicles to ensure
no child is left unattended.  Also, requires each day care facility shall maintain an accurate
child occupancy roster that is located on the vehicle at the beginning and end of each route.
Requires employees of the child care facility to use the roster to account for the location of
each child so that no child is left unattended in the motor vehicle.
Proposed law requires the Department of Children and Family Services to amend its rules
and procedures applicable to the Quality Start Child Care Rating System to include in its
assessment of the quality of care of child care facilities those facilities that meet or exceed
the requirements of proposed law.
