HEALTH: Provides with respect to the Greater New Orleans Biosciences Economic Development District AN ACT1 To amend and reenact the heading of Chapter 27-E of the Title 33 of the Louisiana Revised2 Statutes of 1950, and R.S. 33:2401(A), 9039.61, 9039.62, 9039.65(3), 9039.66(J),3 and 9039.68(A)(13) and (B)(1) and (2), relative to the Greater New Orleans4 Biosciences Economic Development District; to change the name of the Greater New5 Orleans Biosciences Economic Development District to the BioDistrict New6 Orleans; to provide for definitions; to change the composition of the advisory7 committee for the BioDistrict New Orleans; to specify that all BioDistrict New8 Orleans employees are unclassified and are a part of certain retirement system; to9 modify certain subdistrict designations; and to provide for related matters.10 Be it enacted by the Legislature of Louisiana:11 Section 1. The heading of Chapter 27-E of the Title 33 of the Louisiana Revised12 Statutes of 1950 and R.S. 33:2401(A), 9039.61, 9039.62, 9039.65(3), 9039.66(J), and13 9039.68(A)(13) and (B)(1) and (2) are hereby amended and reenacted to read as follows:14 §2401. Unclassified and classified service 15 A. CHAPTER 27-E. GREATER NEW ORLEANS BI OSCIENCES1 ECONOMIC DEVELOPMENT DISTRICT ACT BIODISTRICT NEW ORLEANS2 ACT3 §9039.61. The Greater New Orleans Biosciences Economic Development District4 Act BioDistrict New Orleans Act5 This Chapter shall be known as the "The Greater New Orleans Biosciences6 Economic Development District Act "BioDistrict New Orleans Act".7 §9039.62. Greater New Orleans Biosciences Economic Development District8 BioDistrict New Orleans; creation; territorial jurisdiction9 There is hereby created the Greater New Orleans Biosciences Economic10 Development District BioDistrict New Orleans, referred to in this Chapter as the11 "district". The district shall be composed of all of the territory located in the parish12 of Orleans bounded by Earhart Blvd., Carrollton Ave., Loyola Ave., and Iberville St.13 The district shall be a political subdivision of the state as defined in Article VI,14 Section 44(2) of the Constitution of Louisiana. Pursuant to Article VI, Sections 1915 and 20 of the Constitution of Louisiana, the district, acting through its board of16 commissioners, the governing authority of the district, is hereby granted all of the17 rights, powers, privileges, and immunities accorded by law and the Constitution of18 Louisiana to political subdivisions of the state, including but not limited to the power19 to incur debt.20 * * *21 §9039.65. Definitions22 The following words or terms as used in this Chapter shall have the following23 meaning:24 * * *25 (3) "District" means the Greater New Orleans Biosciences Economic26 Development District BioDistrict New Orleans as further defined in R.S. 33:9039.62.27 * * *28 §9039.66. There shall be an advisory committee of the district created by the board2 of commissioners of the district, which may include but not be limited to3 representatives of the Ochsner Foundation, the New Orleans Foundation, Children's4 Hospital, Department of Veteran's Affairs Medical Center, the University of New5 Orleans, the Greater New Orleans Foundation, Black Economic Development6 Council, the New Orleans Downtown Development District, Dillard University, and7 Southern University of New Orleans , and two members appointed by the mayor of8 the city of New Orleans from a list of nominees submitted by the representatives and9 senators for the districts that overlap the boundaries of the BioDistrict New Orleans.10 * * *11 §9039.68. General powers12 A. In addition to the powers and duties elsewhere granted in this Chapter, the13 board is hereby granted and shall have and may exercise all powers necessary or14 convenient for the carrying out of its objects and purposes, including but not limited15 to the following:16 * * *17 (13)(a) To appoint officers, agents, and employees, including an executive18 director and staff, prescribe their duties, and fix their compensation.19 (b) All employees of the BioDistrict shall be members of the unclassified20 civil service for cities and the Louisiana State Employees' Retirement System. 21 * * *22 B.(1) At least ten days after publication of a notice in the official journal of23 the district, a public hearing shall be conducted and the board may then designate24 one or more areas within or without the boundaries of the district as they may exist25 from time to time as a separate subdistrict or as an enlargement of the original26 district, provided that subdistricts created by the board outside the then current27 boundaries of the district need not be contiguous to the district. Any territory outside28 the original boundaries of the district which is sought to be included in the district29 HLS 11RS-603 ORIGINAL HB NO. 576 Page 4 of 6 CODING: Words in struck through type are deletions from existing law; words underscored are additions. or designated as a separate subdistrict may only be so included or designated subject1 to the approval of the governing board of the parish or municipality having2 jurisdiction over such territory. Each subdistrict shall constitute a separate political3 subdivision of the state, governed by the district board with the same powers of the4 district. Each designated subdistrict area shall be representative of its geographic5 location and designated as "Greater New Orleans Biosciences Economic6 Development Subdistrict No. ___ BioDistrict Economic Development Subdistrict for7 ________________".8 (2) In addition to any other provision of this Chapter, the owner or owners9 of land whether or not contiguous to the district may file with the board a petition10 requesting that there be included as an enlargement of the original district or11 designated as a separate subdistrict, the land described in the petition by metes and12 bounds or by lot and block number if there is a recorded plat of the area to be13 included in the district. The board shall hear and consider the petition and may add14 the land described to the original district or designated as a subdistrict in the petition15 if it is feasible, practicable, and to the advantage of the district. Upon receipt of such16 petition and at least ten days after publication of a notice in the official journal of the17 district, a public hearing shall be conducted and the board shall consider the petition18 and may then enlarge the boundaries of the district or designate one or more areas19 within or without the boundaries of the district as they may exist from time to time20 as a subdistrict if it is practicable, feasible, and to the benefit of the district to do so.21 Subdistricts created outside the then current boundaries of the district also need not22 be contiguous to the district. Any territory outside the district which is sought to be23 included in the district or designated as a subdistrict may only be so included subject24 to the approval of the governing board of the parish or municipality having25 jurisdiction over such territory. Present law (R.S. 33:9039.61) establishes that present law shall be known as the Greater New Orleans Biosciences Economic Development District. Proposed law changes the name of present law from the Greater New Orleans Biosciences Economic Development District to the BioDistrict New Orleans. Present law (R.S. 33:9039.62) creates the Greater New Orleans Biosciences Economic Development District, referred to in present law as the "district". Proposed law changes the name of the Greater New Orleans Biosciences Economic Development District so that "district" now refers to the BioDistrict New Orleans. Present law (R.S. 33:9039.65(3)) defines "District" as the Greater New Orleans Biosciences Economic Development District. Proposed law changes the definition of "District" in present law meaning the Greater New Orleans Biosciences Economic Development District to the BioDistrict New Orleans.
