HEALTH: Provides with respect to the Greater New Orleans Biosciences Economic
Development District
AN ACT1
To amend and reenact the heading of Chapter 27-E of Title 33 of the Louisiana Revised2
Statutes of 1950 and R.S. 33:9039.61, 9039.62, 9039.65(3), 9039.66(J), and3
9039.68(B)(1) and (2), relative to the Greater New Orleans Biosciences Economic4
Development District; to change the name of the Greater New Orleans Biosciences5
Economic Development District to the BioDistrict New Orleans; to provide for6
definitions; to change the composition of the advisory committee for the BioDistrict7
New Orleans; to modify certain subdistrict designations; and to provide for related8
matters.9
Be it enacted by the Legislature of Louisiana:10
Section 1. The heading of Chapter 27-E of Title 33 of the Louisiana Revised Statutes11
of 1950 and R.S. 33:9039.61, 9039.62, 9039.65(3), 9039.66(J), and 9039.68(B)(1) and (2)12
are hereby amended and reenacted to read as follows:13
CHAPTER 27-E.  GREATER NEW ORLEANS BI OSCIENCES14
ECONOMIC DEVELOPMENT DISTRICT ACT15

§9039.61. The Greater New Orleans Biosciences Economic Development District17
Act BioDistrict New Orleans Act18
This Chapter shall be known as the "The Greater New Orleans Biosciences19

§9039.62.  Greater New Orleans Biosciences Economic Development District1
BioDistrict New Orleans; creation; territorial jurisdiction2
There is hereby created the Greater New Orleans Biosciences Economic3
Development District BioDistrict New Orleans, referred to in this Chapter as the4
"district". The district shall be composed of all of the territory located in the parish5
of Orleans bounded by Earhart Blvd., Carrollton Ave., Loyola Ave., and Iberville St.6
The district shall be a political subdivision of the state as defined in Article VI,7
Section 44(2) of the Constitution of Louisiana. Pursuant to Article VI, Sections 198
and 20 of the Constitution of Louisiana, the district, acting through its board of9
commissioners, the governing authority of the district, is hereby granted all of the10
rights, powers, privileges, and immunities accorded by law and the Constitution of11
Louisiana to political subdivisions of the state, including but not limited to the power12
to incur debt.13

§9039.65.  Definitions15
The following words or terms as used in this Chapter shall have the following16
meaning:17

(3) "District" means the Greater New Orleans Biosciences Economic19
Development District BioDistrict New Orleans as further defined in R.S. 33:9039.62.20

§9039.66.  Board of commissioners; members; officers; advisory committee22

J.  There shall be an advisory committee of the district created by the board24
of commissioners of the district, which may include but not be limited to25
representatives of the Ochsner Foundation, the New Orleans Foundation, Children's26
Hospital, Department of Veteran's Affairs Medical Center, the University of New27
Orleans, the Greater New Orleans Foundation, Black Economic Development28
Council, the New Orleans Downtown Development District, Dillard University, and29 HLS 11RS-603	ENGROSSED

Southern University of New Orleans, and two members appointed by the mayor of1
the city of New Orleans from a list of nominees submitted by the representatives and2
senators for the districts that overlap the boundaries of the BioDistrict New Orleans.3

§9039.68.  General powers5

B.(1) At least ten days after publication of a notice in the official journal of7
the district, a public hearing shall be conducted, and the board may then designate8
one or more areas within or without the boundaries of the district as they may exist9
from time to time as a separate subdistrict or as an enlargement of the original10
district, provided that subdistricts created by the board outside the then current11
boundaries of the district need not be contiguous to the district. Any territory outside12
the original boundaries of the district which is sought to be included in the district13
or designated as a separate subdistrict may only be so included or designated subject14
to the approval of the governing board of the parish or municipality having15
jurisdiction over such territory.  Each subdistrict shall constitute a separate political16
subdivision of the state, governed by the district board with the same powers of the17
district. Each designated subdistrict area shall be representative of its geographic18
location and designated as "Greater New Orleans Biosciences Economic19
Development Subdistrict No. ___ BioDistrict Economic Development Subdistrict for20
________________".21
(2) In addition to any other provision of this Chapter, the owner or owners22
of land whether or not contiguous to the district may file with the board a petition23
requesting that there be included as an enlargement of the original district or24
designated as a separate subdistrict, the land described in the petition by metes and25
bounds or by lot and block number if there is a recorded plat of the area to be26
included in the district. The board shall hear and consider the petition and may add27
the land described to the original district or designated as a subdistrict in the petition28

petition and at least ten days after publication of a notice in the official journal of the1

and may then enlarge the boundaries of the district or designate one or more areas3
within or without the boundaries of the district as they may exist from time to time4
as a subdistrict if it is practicable, feasible, and to the benefit of the district to do so.5
Subdistricts created outside the then current boundaries of the district also need not6
be contiguous to the district. Any territory outside the district which is sought to be7
included in the district or designated as a subdistrict, may only be so included subject8
to the approval of the governing board of the parish or municipality having9
jurisdiction over such territory.  Each subdistrict shall constitute a separate political10
subdivision of the state, governed by the district board with the same powers of the11

Present law (R.S. 33:9039.61 et seq.) creates and provides for the Greater New Orleans
Biosciences Economic Development District as a political subdivision of the state located
within the city of New Orleans. Provides for district boundaries.  Provides that the district
shall be governed by a board of commissioners composed of 13 members. Provides further
with respect to the powers and duties of the board and the district.
Proposed law changes the name of the district from the Greater New Orleans Biosciences
Economic Development District to the BioDistrict New Orleans. Proposed law otherwise
retains present law.
Present law (R.S. 33:9039.66(J)) requires the board of commissioners to create an advisory
committee of the district, which may include but not be limited to representatives of the

Foundation, Black Economic Development Council, the New Orleans Downtown
Development District, Dillard University, and Southern University of New Orleans.
Proposed law adds two members to the advisory committee who shall be appointed by the
mayor of the city of New Orleans from a list of nominees submitted by the representatives
and senators for the districts that overlap the boundaries of the district.
Present law (R.S. 33:9039.68(B)(1) and (2)) requires that each designated subdistrict area
be designated as "Greater New Orleans Biosciences Economic Development Subdistrict No.
        ".
Proposed law changes present law by requiring that each designated subdistrict area be
representative of its geographic location and designated as "BioDistrict Economic
Development Subdistrict for ________________".
(Amends R.S. 33:9039.61, 9039.62, 9039.65(3), 9039.66(J), and 9039.68(B)(1) and (2))
Summary of Amendments Adopted by House
Committee Amendments Proposed by House Committee on Municipal, Parochial and
Cultural Affairs to the original bill.
1. Removes proposed law that would have provided that all employees of the
district shall be members of the unclassified civil service for cities of over
100,000 persons and members of the La. State Employees' Retirement System.
