AN ACT1
To amend and reenact the heading of Chapter 27-E of Title 33 of the Louisiana Revised2
Statutes of 1950 and R.S. 33:9039.61, 9039.62, 9039.65(3), 9039.66(A)(1) and (J),3
and 9039.68(B)(1) and (2), relative to the Greater New Orleans Biosciences4
Economic Development District; to change the name of the Greater New Orleans5
Biosciences Economic Development District to the BioDistrict New Orleans; to6
provide for definitions; to change the composition of the board of commissioners and7
the advisory committee for the BioDistrict New Orleans; to modify certain8
subdistrict designations; and to provide for related matters.9
Be it enacted by the Legislature of Louisiana:10
Section 1. The heading of Chapter 27-E of Title 33 of the Louisiana Revised Statutes11
of 1950 and R.S. 33:9039.61, 9039.62, 9039.65(3), 9039.66(A)(1) and (J), and12
9039.68(B)(1) and (2) are hereby amended and reenacted to read as follows:13
CHAPTER 27-E.  GREATER NEW ORLEANS BI OSCIENCES14
ECONOMIC DEVELOPMENT DISTRICT ACT15

§9039.61.  The Greater New Orleans Biosciences Economic Development District17
Act BioDistrict New Orleans Act18
This Chapter shall be known as the "The Greater New Orleans Biosciences19
Economic Development District Act "BioDistrict New Orleans Act".20 ENROLLEDHB NO. 576

§9039.62.  Greater New Orleans Biosciences Economic Development District1
BioDistrict New Orleans; creation; territorial jurisdiction2
There is hereby created the Greater New Orleans Biosciences Economic3
Development District BioDistrict New Orleans, referred to in this Chapter as the4
"district". The district shall be composed of all of the territory located in the parish5
of Orleans bounded by Earhart Blvd., Carrollton Ave., Loyola Ave., and Iberville St.6
The district shall be a political subdivision of the state as defined in Article VI,7
Section 44(2) of the Constitution of Louisiana. Pursuant to Article VI, Sections 198
and 20 of the Constitution of Louisiana, the district, acting through its board of9
commissioners, the governing authority of the district, is hereby granted all of the10
rights, powers, privileges, and immunities accorded by law and the Constitution of11
Louisiana to political subdivisions of the state, including but not limited to the power12
to incur debt.13

§9039.65.  Definitions15
The following words or terms as used in this Chapter shall have the following16
meaning:17

(3) "District" means the Greater New Orleans Biosciences Economic19
Development District BioDistrict New Orleans as further defined in R.S. 33:9039.62.20

§9039.66.  Board of commissioners; members; officers; advisory committee22
A.(1) The district shall be governed by a board of commissioners referred23
to in this Chapter as the "board" consisting of thirteen fifteen members comprised24
of the following:25
(a) The president of the Louisiana State University System or his designee.26
(b)  The president of Tulane University or the president's designee.27
(c)  The president of Xavier University or the president's designee.28 ENROLLEDHB NO. 576

(d) The chancellor of Delgado Community College or the chancellor's1
designee.2
(e)  The mayor of the city of New Orleans or the mayor's designee.3
(f) Three appointments by the mayor of the city of New Orleans from4
nominees submitted by Greater New Orleans, Inc., the New Orleans Chamber of5
Commerce, and the New Orleans Business Council.6
(g) Four appointed by the governor, at least two of which shall be residents7
of Orleans Parish.8
(h) The secretary of the Department of Economic Development or the9
secretary's designee.10
(i) Two members who reside within the boundaries of the BioDistrict New11
Orleans, to be appointed by the representatives and senators for the districts that12
overlap the boundaries of the BioDistrict New Orleans.13

J.  There shall be an advisory committee of the district created by the board15
of commissioners of the district, which may include but not be limited to16
representatives of the Ochsner Foundation, the New Orleans Foundation, Children's17
Hospital, Department of Veteran's Affairs Medical Center, the University of New18
Orleans, the Greater New Orleans Foundation, Black Economic Development19
Council, the New Orleans Downtown Development District, Dillard University, and20
Southern University of New Orleans, and two members appointed by the21
representatives and senators for the districts that overlap the boundaries of the22
BioDistrict New Orleans.23

§9039.68.  General powers25

B.(1) At least ten days after publication of a notice in the official journal of27
the district, a public hearing shall be conducted, and the board may then designate28 ENROLLEDHB NO. 576

one or more areas within or without the boundaries of the district as they may exist1
from time to time as a separate subdistrict or as an enlargement of the original2
district, provided that subdistricts created by the board outside the then current3
boundaries of the district need not be contiguous to the district. Any territory outside4
the original boundaries of the district which is sought to be included in the district5
or designated as a separate subdistrict may only be so included or designated subject6
to the approval of the governing board of the parish or municipality having7
jurisdiction over such territory.  Each subdistrict shall constitute a separate political8
subdivision of the state, governed by the district board with the same powers of the9
district. Each designated subdistrict area shall be representative of its geographic10
location and designated as "Greater New Orleans Biosciences Economic11
Development Subdistrict No. ___ BioDistrict Economic Development Subdistrict for12
________________".13
(2) In addition to any other provision of this Chapter, the owner or owners14
of land whether or not contiguous to the district may file with the board a petition15
requesting that there be included as an enlargement of the original district or16
designated as a separate subdistrict, the land described in the petition by metes and17
bounds or by lot and block number if there is a recorded plat of the area to be18
included in the district. The board shall hear and consider the petition and may add19
the land described to the original district or designated as a subdistrict in the petition20
if it is feasible, practicable, and to the advantage of the district. Upon receipt of such21
petition and at least ten days after publication of a notice in the official journal of the22
district, a public hearing shall be conducted, and the board shall consider the petition23
and may then enlarge the boundaries of the district or designate one or more areas24
within or without the boundaries of the district as they may exist from time to time25
as a subdistrict if it is practicable, feasible, and to the benefit of the district to do so.26
Subdistricts created outside the then current boundaries of the district also need not27

included in the district or designated as a subdistrict, may only be so included subject1
