HOUSE BILL NO. 77

PUBLIC LANDS/STATE:  Provides for the transfer of state property in Iberia Parish
AN ACT1
To authorize and provide for the transfer of certain state property; to authorize the transfer2
of certain state property in Iberia Parish; to provide for the property description; to3
provide for reservation of mineral rights; to provide terms and conditions; to provide4
an effective date; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  The secretary of the Department of Transportation and Development,7
notwithstanding any other provision of law to the contrary, is hereby authorized and8
empowered to convey, transfer, assign, lease, or deliver any interest, excluding mineral9
rights, the state may have to all or any portion of the following described parcel of property10
to the city of New Iberia:11
From a point on the center line of State Project No. 823-46-0004, at Station12
501+36.10 being the center line Lewis Street; thence proceed N34/21'14" W a13
distance of 126.10 feet to the point of beginning; thence proceed N50/09'39"E a14
distance of 98.63 feet to a point and corner; thence proceed N50/03'30"E a distance15
of 135.80 feet to a point and corner; thence proceed N49/48'36"E a distance of16
339.28 feet to a point and corner; thence proceed N40/11'24"W a distance of 26.3317
feet to a point and corner; thence proceed N35/27'22"E a distance of 50.80 feet to a18
point and corner; thence proceed N41/40'28"E a distance of 85.96 feet to a point and19
corner; thence proceed N46/10'44"E a distance of 68.93 feet to a point and corner;20
thence proceed S65/15'23"E a distance of 140.31 feet to a point and corner; thence21
proceed N79/49'40"E a distance of 15.14 feet to a point and corner; thence proceed22
S58/12'18"E a distance of 17.43 feet to a point and corner; thence proceed23
S45/26'29"W a distance of 199.38 feet to a point and corner; thence proceed24
S48/25'16"W a distance of 201.56 feet to a point and corner; thence proceed25
S55/32'45.9"W a distance of 328.16 feet to a point and corner; thence proceed along26
a curve to the right having a radius of 160.00 feet. whose arc length is 159.80 feet27
and whose chord length is 153.24 feet and chord bearing S83/11'30"W to the point28
of beginning. AII of which comprises Parcel "A" as shown. and contains an area of29

Section 2. The secretary of the Department of Transportation and Development is1
hereby authorized to enter into such agreements, covenants, conditions, and stipulations and2
to execute such documents as necessary to properly effectuate any conveyance, transfer,3
assignment, lease, or delivery of title, excluding mineral rights, to the property described in4
Section 1, and as more specifically described in any such agreements entered into and5
documents executed by and between the secretary of the Department of Transportation and6
Development and the city of New Iberia, in exchange of consideration proportionate to the7
appraised value of the property.8
Section 3. This Act shall become effective upon signature by the governor or, if not9
signed by the governor, upon expiration of the time for bills to become law without signature10
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If11
vetoed by the governor and subsequently approved by the legislature, this Act shall become12
effective on the day following such approval.13
