Requires hospitals, prior to discharge, to provide parents of newborns educational information on Pertussis disease and the availability of a vaccine. (8/15/11) AN ACT1 To enact R.S. 40:2022, relative to health care information; to require hospitals to provide2 certain health care information to certain patients; to provide for the development3 and dissemination of the health care information by the Department of Health and4 Hospitals; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 40:2022 is hereby enacted to read as follows: 7 ยง2022. Health care information; pertussis8 A. The legislature hereby finds that it is in the best interest of the9 children born in this state that certain health care information be provided to10 parents of newborns concerning the Pertussis disease. Pertussis (whooping11 cough) is a very contagious disease caused by a type of bacteria called12 Bordetella pertussis and is one of the most commonly occurring13 vaccine-preventable diseases in the United States.14 B. Pertussis disease and the availability of a vaccine to protect against contracting1 the disease. Such information shall include, but not be limited to, information2 on the recommendation of the Centers for Disease Control and Prevention that3 parents receive the appropriate vaccination during the postpartum period to4 help protect their newborns from the transmission of Pertussis.5 C. The Department of Health and Hospitals shall, by January 1, 2012,6 develop and disseminate to every hospital in the state information consistent7 with the provisions of this Section.8 D. Nothing in this Section shall require any hospital or the office of9 public health within the Department of Health and Hospital to provide or pay10 for any vaccination against Pertussis.11 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Greg Waddell. DIGEST Proposed law provides that on and after January 1, 2012, every licensed hospital in the state of Louisiana shall, prior to discharge, provide parents of newborns educational information provided by DHH on the Pertussis disease and the availability of a vaccine to protect against contracting the disease. Such information shall include, but not be limited to, information on the CDC's recommendation that parents receive the appropriate vaccination during the postpartum period to help protect their newborns from the transmission of Pertussis. Proposed law requires DHH to develop and disseminate to every hospital in the state information consistent with the provisions of proposed law. Effective August 15, 2011. (Adds R.S. 40:2022)
