Exempts certain individuals from the boating safety education requirement. (gov sig) AN ACT1 To amend and reenact R.S. 34:851.36(B), relative to motorboats and vessels; to provide for2 boating safety education; to exempt certain individuals from the boating safety3 education requirement; to provide for an effective date; and to provide for related4 matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 34:851.36(B) is hereby amended and reenacted to read as follows:7 ยง851.36. Boating safety education required8 * * *9 B. (1) A motorboat may be operated if any person on board or participating10 in any boating activity from the motorboat is over the age of eighteen and, if required11 to have completed a boating safety course under the provisions of Subsection A of12 this Section, has completed the required boating safety course.13 (2) A person who is licensed by the United States Coast Guard to serve14 as a master of a vessel shall be exempt from the provisions of Subsection A of15 this Section.16 * * *17 SB NO. 23 SLS 11RS-10 ORIGINAL Page 2 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. Section 2. This Act shall become effective upon signature by the governor or, if not1 signed by the governor, upon expiration of the time for bills to become law without signature2 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If3 vetoed by the governor and subsequently approved by the legislature, this Act shall become4 effective on the day following such approval.5 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by J. DIGEST Present law provides that no person born after Jan. 1, 1984, can operate a motorboat powered by a motor in excess of 10 horsepower unless he has successfully completed a boating safety class approved by the National Association of State Boating Law Administrators. Further provides that a person who has completed an approved boating safety class must be in possession of evidence of such completion when operating such a boat. Proposed law exempts a person who is licensed by the United States Coast Guard to serve as a master of a vessel from present law. Effective upon signature of the governor or lapse of time for gubernatorial action. (Amends R.S. 34:851.36(B))
