SPECIAL DISTRICTS. Provides relative to the governing authority of the Sunset Drainage
District of St. Charles Parish. (gov sig)
AN ACT1
To enact R.S. 38:1607(C), relative to St. Charles Parish; to provide that the St. Charles2
Parish Council may replace the board of commissioners of the Sunset Drainage3
District as the governing authority of the district by ordinance; and to provide for4
related matters.5
Notice of intention to introduce this Act has been published.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 38:1607(C) is hereby enacted to read as follows: 8
ยง1607. Board of commissioners; qualifications; compensation and expenses9

C. Notwithstanding the provisions of Paragraph (A) of this Section, the11
St. Charles Parish Council may replace the board of commissioners of the12
Sunset Drainage District as the governing authority of the district by adopting13
an ordinance appointing and designating the St. Charles Parish Council as the14
governing authority of the district.  The ordinance shall establish an effective15
date for such change in governance and the delivery of records, accounts and16
monies to the council.17 SB NO. 261

Section 2. This Act shall become effective upon signature by the governor or, if not1
signed by the governor, upon expiration of the time for bills to become law without signature2
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If3
vetoed by the governor and subsequently approved by the legislature, this Act shall become4
effective on the day following such approval.5

DIGEST
Present law provides that all drainage districts will be governed and controlled by five
commissioners to be known as the board of commissioners.
Proposed law makes an exception to present law for the Sunset Drainage District, which
provides that the St. Charles Parish Council may replace the board of commissioners of
Sunset Drainage District as the governing authority of the district by adopting an ordinance
appointing and designating the St. Charles Parish Council as the governing authority of the
district.
Effective upon signature of the governor or lapse of time for gubernatorial action.
