GROUP BENEFITS PROGRAM. Provides coverage for developmentally disabled
dependents of classified or unclassified state civil service employees by life, health or other
programs sponsored by the Office of Group Benefits under certain circumstances. (8/15/11)
AN ACT1
To amend and reenact R.S.42:808(E), relative to eligibility in group programs; to provide2
coverage for a developmentally disabled dependent of a classified or unclassified3
state civil service employee by life, health or other programs sponsored by the Office4
of Group Benefits under certain circumstances, and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 42:808 (E) is hereby amended and reenacted to read as follows: 7

E. Notwithstanding any provision of law to the contrary, any10
developmentally disabled person who became disabled prior to attaining the age of11
twenty-one, with one parent whose coverage of such person was terminated as a12
result of lost employment of the parent and one parent who is an employe e, as13
defined in R.S. 42:808(A)(3), (A)(1) and (3), participating in life, health, or other14
programs sponsored by the Office of Group Benefits, shall be covered as a dependent15
of such parent participating in life, health, or other programs sponsored by the Office16
of Group Benefits, regardless of the age of the developmentally disabled person.17 SB NO. 38

DIGEST
Present law requires dependent coverage for a developmentally disabled person, regardless
of age, in any life, health, or other program sponsored by the Office of Group Benefits under
the following conditions:
1. The person became developmentally disabled prior to attaining age 21.
2. The disabled person was covered under a parent's policy of insurance but coverage
has terminated due to the parent's loss of employment.
3. The disabled person's other parent is a full-time employee of a school board and
participates in a life, health, or other program sponsored by the Office of Group
Benefits.
Proposed law retains present law requirements in Items 1 and 2 above but includes in Item
3 dependent coverage if the other parent is employed in the classified or unclassified state
civil service.
Effective August 15, 2011.
