SENATE RESOLUTION NO. 8
BY SENATOR BROOME 
TRUSTS. Requests Louisiana State Law Institute to study authorizing creation of
testamentary and inter vivos trusts to provide for the care of an animal.
A RESOLUTION1
To urge and request the Louisiana State Law Institute to study revising state law to authorize2
the creation of testamentary and inter vivos trusts to provide for the care of an3
animal.4
WHEREAS, as of 2011, over forty states have enacted legislation authorizing under5
trust and estate laws the creation of a trust to provide for the care of an animal; and6
WHEREAS, such legislation is commonly referred to as "pet trust" or "animal trust"7
legislation; and 8
WHEREAS, states that have enacted such legislation include Texas, Arkansas,9
Alabama, Florida, and Georgia; and10
WHEREAS, Louisiana is one of the few remaining states that have not enacted such11
legislation; and12
WHEREAS, the Uniform Probate Code and the Uniform Trust Code, promulgated13
by the National Conference of Commissioners on Uniform State Laws, include provisions14
for the establishment of "pet trusts".15
THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana16
does hereby urge and request the Louisiana State Law Institute to study revising state law17
to authorize creation of testamentary and inter vivos trusts to provide for the care of an18 SR NO. 8

animal.1
BE IT FURTHER RESOLVED that a copy of the Law Institute report, together with2
any proposed legislation, be submitted to the Legislature of Louisiana not later than February3
15, 2012.4
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the5
Louisiana State Law Institute.6
