Page 1 of 1 Regular Session, 2011 ENROLLED SENATE RESOLUTION NO. 8 BY SENATOR BROOME A RESOLUTION To urge and request the Louisiana State Law Institute to study revising state law to authorize the creation of testamentary and inter vivos trusts to provide for the care of an animal. WHEREAS, as of 2011, over forty states have enacted legislation authorizing under trust and estate laws the creation of a trust to provide for the care of an animal; and WHEREAS, such legislation is commonly referred to as "pet trust" or "animal trust" legislation; and WHEREAS, states that have enacted such legislation include Texas, Arkansas, Alabama, Florida, and Georgia; and WHEREAS, Louisiana is one of the few remaining states that have not enacted such legislation; and WHEREAS, the Uniform Probate Code and the Uniform Trust Code, promulgated by the National Conference of Commissioners on Uniform State Laws, include provisions for the establishment of "pet trusts". THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana does hereby urge and request the Louisiana State Law Institute to study revising state law to authorize creation of testamentary and inter vivos trusts to provide for the care of an animal. BE IT FURTHER RESOLVED that a copy of the Law Institute report, together with any proposed legislation, be submitted to the Legislature of Louisiana not later than February 15, 2012. BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the Louisiana State Law Institute. PRESIDENT OF THE SENATE
